De-commissioning due to Emergency. 17.6.1 If, in the reasonable opinion of the Concessionaire, there exists an Emergency which warrants de-commissioning and closure of the whole or any part of the Bus Terminal, the Concessionaire shall be entitled to decommission and close the whole or any part of the Bus Terminal to Users and passengers for so long as such Emergency and the consequences thereof warrant; provided that such de- commissioning and particulars thereof shall be notified by the Concessionaire to the Authority without any delay, and the Concessionaire shall diligently carry out and abide by any reasonable directions that the Authority may give for dealing with such Emergency.
17.6.2 The Concessionaire shall re-commission the Bus Terminal or the affected part thereof as quickly as practicable after the circumstances leading to its de- commissioning and closure have ceased to exist or have so abated as to enable the Concessionaire to re-commission the Bus Terminal and shall notify the Authority of the same without any delay.
17.6.3 Any decommissioning or closure of any part of the Bus Terminal and the recommissioning thereof shall, as soon as practicable, be brought to the notice of affected persons by means of public announcements/notice.
De-commissioning due to Emergency. 17.6.1 If, in the reasonable opinion of the Concessionaire, there exists an Emergency which warrants de-commissioning and closure of the whole or any part of the Project, the Concessionaire shall be entitled to de-commission and close the whole or any part of the Project for so long as such Emergency and the consequences thereof warrant; provided that such de-commissioning and particulars thereof shall be notified by the Concessionaire to the Authority Without any delay, and the Concessionaire shall diligently carry out and abide by any reasonable directions that the Authority may give for dealing with such Emergency.
17.6.2 The Concessionaire shall re-commission the Project or the affected part thereof as quickly as practicable after the circumstances leading to its de-commissioning and closure have ceased to exist or have so abated as to enable the Concessionaire to re- commission the Project and shall notify the Authority of the same without any delay.
17.6.3 Any decommissioning or closure of any part of the Project and the re- commissioning thereof shall, as soon as practicable, be brought to the notice of affected persons by means of public announcements/notice.
De-commissioning due to Emergency. 11.4.1. If in the reasonable opinion of the Licensee, there exists an Emergency which warrants de- commissioning and closure of the whole or any part of the property business space/ premises, the Licensee shall be entitled to de-commission and close the whole or any part of the property business space allotted to him so long as such Emergency and the consequences thereof warrant; provided that such decommissioning and particulars thereof shall be notified by the Licensee to Maha-Metro without any delay, and the Licensee shall diligently carry out and abide by any reasonable directions that Maha-Metro may give for dealing with such Emergency.
11.4.2. The Licensee shall re-commission the operations and mainatenace of the premises or the affected part thereof as quickly as possible after the circumstances leading to its decommissioning and closure have ceased to exist or have so abated as to enable the Licensee to re-commission the property business space /premises. However the recommissioning of the space be done only after the written approval of Maha-Metro.
De-commissioning due to Emergency. 17.6.1 If, in the reasonable opinion of the Concessionaire, there exists an Emergency which warrants de-commissioning and closure to traffic of the whole or any part of the Port, the Concessionaire shall be entitled to de-commission and close the whole or any part of the Port to traffic for so long as such Emergency and the consequences thereof warrant; provided that such de-commissioning and particulars thereof shall be notified by the Concessionaire to the Authority without any delay, and the Concessionaire shall diligently carry out and abide by any reasonable directions that the Authority may give for dealing with such Emergency.
17.6.2 The Concessionaire shall re-commission the Port or the affected part thereof as quickly as practicable after the circumstances leading to its de-commissioning and closure have ceased to exist or have so abated as to enable the Concessionaire to re-commission the Port and shall notify the Authority of the same without any delay.
De-commissioning due to Emergency. 16.6.1 If, in the reasonable opinion of the MDO, there exists an emergency which warrants de- commissioning or shut-down of the whole or any part of the Mines, Concentrator Plant and equipment, the MDO shall be entitled to de-commission or shut down the whole or any part of the Mines and equipment for so long as such emergency exists and the consequences thereof warrant; provided that such de-commissioning or shut-down and particulars thereof shall be notified by the MDO to HCL without any delay, and the MDO shall diligently carry out and abide by any reasonable directions that HCL may give for dealing with such emergency. For the avoidance of doubt, the MDO acknowledges and agrees that any de- commissioning or shut-down hereunder shall conform to the provisions of the Mines Act, 1952.
16.6.2 The MDO shall re-commission the Mines, Concentrator Plant and equipment or any part thereof as quickly as practicable after the circumstances leading to its decommissioning or shut down have ceased to exist or have so abated as to enable the MDO to re-commission the Mines and equipment and shall notify HCL of the same forthwith. For avoidance of any doubt, all such commissioning and decommissions shall be done at risk and cost to MDO and no separate payment shall be made by HCL for such event.
De-commissioning due to Emergency. 15.5.1. If, in the reasonable opinion of the SPD, there exists an Emergency which warrants de-commissioning and closure of the whole or any part of the Solar Rooftop Power System, the SPD shall be entitled to de-commission and close the whole or any part of the Solar Rooftop Power System for so long as such Emergency and the consequences thereof warrant; provided that such de- commissioning and particulars thereof shall be notified by the SPD to Railways without any delay, and the SPD shall diligently carry out and abide by any reasonable directions that Railways may give for dealing with such Emergency .
15.5.2. The SPD shall re-commission the Solar Rooftop Power System or the affected part thereof as quickly as practicable after the circumstances leading to its de- commissioning and closure have ceased to exist or have so abated as to enable the SPD to re-commission the Solar Rooftop Power System and shall notify Railways of the same without any delay.
15.5.3. Any decommissioning or closure of any part of the Solar Rooftop Power System and the re-commissioning thereof shall, as soon as practicable, be brought to the notice of affected persons by means of public announcements/notice.
De-commissioning due to Emergency. 17.6.1 If, in the reasonable opinion of the Concessionaire, there exists an Emergency which warrants de-commissioning and closure of the whole or any part of the Rail System, the Concessionaire shall be entitled to de-commission and close the whole or any part of the Rail System for so long as such Emergency and the consequences thereof warrant; provided that such de-commissioning and particulars thereof shall be notified by the Concessionaire to MOR without any delay, and the Concessionaire shall diligently carry out and abide by any reasonable directions that MOR may give for dealing with such Emergency.
17.6.2 The Concessionaire shall re-commission the Rail System or the affected part thereof as quickly as practicable after the circumstances leading to its de-commissioning and closure have ceased to exist or have so abated as to enable the Concessionaire to re- commission the Rail System and shall notify MOR of the same without any delay.
De-commissioning due to Emergency. If, in the reasonable opinion of the Concessionaire, there exists an Emergency which warrants de-commissioning and closure to traffic of the whole or any part of the Haji Bunder (Sewree) to Elephanta Island Ropeway, the Concessionaire shall be entitled to decommission and close the whole or any part of the Haji Bunder (Sewree) to Elephanta Island Ropeway to traffic for so long as such Emergency and the consequences thereof warrant; provided that such decommissioning and particulars thereof shall be notified by the Concessionaire to the Authority without any delay, and the Concessionaire shall diligently carry out and abide by any reasonable directions that the Authority may give for dealing with such Emergency. The Concessionaire shall re-commission the Haji Bunder (Sewree) to Elephanta Island Ropeway or the affected part thereof as quickly as practicable after the circumstances leading to its decommissioning and closure have ceased to exist or have so abated as to enable the Concessionaire to re-commission the Haji Bunder (Sewree) to Elephanta Island Ropeway and shall notify the Authority of the same without any delay. Any decommissioning or closure of any part of the Haji Bunder (Sewree) to Elephanta Island Ropeway and the re-commissioning thereof shall, as soon as practicable, be brought to the notice of affected persons by means of public announcements/notice.
De-commissioning due to Emergency. 17.6.1 If, in the reasonable opinion of the Authority, there exists an Emergency which warrants de- commissioning of a Bus, the Authority shall be entitled to de-commission the Bus for so long as such Emergency and the consequences thereof warrant; provided that such de- commissioning and particulars thereof shall be notified by the Authority to the Operator without any delay, and the Operator shall diligently carry out and abide by any reasonable directions that the Authority may give for dealing with such Emergency.
17.6.2 The Operator shall re-commission the Bus as quickly as practicable after the circumstances leading to its de-commissioning have ceased to exist or have so abated as to enable the Operator to re-commission the Bus and shall notify the Authority of the same without any delay.
De-commissioning due to Emergency. 17.6.1 If, in the reasonable opinion of the Authority, there exists an Emergency which warrants de- commissioning of a Bus, the Authority shall be entitled to de-commission the Bus for so long as such Emergency and the consequences thereof warrant; provided that such de-commissioning and particulars thereof shall be notified by the Authority to the Operator without any delay, and the Operator shall diligently carry out and abide by any reasonable directions that the Authority may give for dealing with such Emergency.
17.6.2 The Operator shall re-commission the Bus as quickly as practicable after the circumstances leading to its de-commissioning have ceased to exist or have so abated as to enable the Operator to re-commission the Bus and shall notify the Authority of the same without any delay.
17.6.3 If incase of accidents or any other major repairs the bus becomes inoperable or cannot be repaired the Operator shall replace the bus within one month,failing which Operator shall be liable to pay Damages at the rate of 0.2% of the Performance Securityequivalent to one bus, per day per bus.
