Legal Action Against Parents For Willful Student Misconduct. ‌ If a student cuts, defaces, or otherwise injures in any way any property, real or personal, belonging to unit member, the unit member may submit a written request that the District take legal action against the student’s parents or guardians (Ed. Code 48905). The District shall make a cost/benefit analysis and decide whether to exercise the rights provided to the District by Education Code Section 48905. The District’s exercise of its discretion under this section of the Agreement shall not be subject to review by an arbitrator and shall not be subject to the grievance procedure in Article 8 of this agreement. Nothing in this Agreement shall prevent a unit member from taking appropriate legal action on his/her own.
