Lessee Conditions. The obligation of the Lessee to sell and lease back the Undivided Interest and the Real Property Interest on the Closing Date pursuant to Section 4 shall be subject to the fulfillment on or prior to the Closing Date of the following conditions precedent, in each case in form and substance satisfactory to the Lessee:
