Unsafe Conditions. In accordance with 29 CFR § 1977, occasions might arise when an employee is confronted with a choice between not performing assigned tasks or subjecting himself/herself to serious injury or death arising from a hazardous condition at the workplace. If the employee, with no reasonable alternative, refuses in good faith to expose himself/herself to the dangerous condition, he/she would be protected against subsequent discrimination. The condition causing the employee's apprehension of death or injury must be of such a nature that a reasonable person, under the circumstances then confronting the employee, would conclude that there is a real danger of death or serious injury and that there is insufficient time, due to the urgency of the situation, to eliminate the danger by resorting to regular statutory enforcement channels. In addition, in such circumstances, the employee, where possible, must also have sought from his Employer, and been unable to obtain, a correction of the dangerous condition.
Unsafe Conditions. All employees shall report promptly unsafe conditions related to physical plant, tools and equipment to their supervisor. Additionally, matters related to patients, residents, clients, youths and inmates which are abnormal to the employees’ workplace shall be reported to their supervisor. If the supervisor does not xxxxx the problem, the matter should then be reported to an Agency/Facility safety designee. In such event, the employee shall not be disciplined for reporting these matters to these persons. An Agency/Facility safety designee shall xxxxx the problem or will report to the employee or his/her representative in five (5) days or less reasons why the problem cannot be abated in an expeditious manner. The appropriate Health and Safety Committee(s) will be provided the name(s) of the Agency/Facility safety designee(s). No employee shall be required to operate equipment that any reasonable operator in the exercise of ordinary care would know might cause injury to the employee or anyone else. An employee shall not be subject to disciplinary action by reason of his/her failure or refusal to operate or handle any such unsafe piece of equipment. In the event that a disagreement arises between the employee and his/her supervisor concerning the question of whether or not a particular piece of equipment is unsafe, the Agency/Facility safety designee shall be notified and the employee shall not be required to operate the equipment until the Agency/Facility safety designee has inspected said equipment and deemed it safe for operation. An employee shall not be disciplined for a good faith refusal to engage in an alleged unsafe or dangerous act or practice which is abnormal to the place of employment and/or position description of the employee. Such a refusal shall be immediately reported to an Agency/Facility safety designee for evaluation. An employee confronted with an alleged unsafe situation must assure the health and safety of a person entrusted to his/her care or for whom he/she is responsible and the general public by performing his/her duties according to Agency policies and procedures before refusing to perform an alleged unsafe or dangerous act or practice pursuant to this Section. Nothing in this Section shall be construed as preventing an employee from grieving the safety designee’s decision.

If the supervisor does not xxxxx the problem, the matter should then be reported to the appropriate management designee. In such event, employees shall not be disciplined for reporting these matters to these persons. The appropriate supervisor shall attempt to xxxxx the problem or will report to the employee or his/her representative in five (5) days or less reasons why the problem cannot be abated in an expeditious manner.
Unsafe Conditions. All employees shall report promptly unsafe conditions to their facility commander or designee by use of an inter-office communication. Contemporaneously the bargaining unit member shall fax a copy of the inter-office communication to the Union. Employees shall not be disciplined for reporting these matters to these persons. The appropriate District/Section Commander or designee shall xxxxx the problem or will report to the bargaining unit employee in five (5) days or less, in writing, reasons why the problem cannot be abated in an expeditious manner. Should an employee not be satisfied with the written response received, the employee shall be able to file a grievance directly at Step Two (2) of the grievance procedure outlined in Section 20.07.
Unsafe Conditions. If an employee has justifiable reason to believe that his safety is in danger due to an alleged unsafe working condition, or alleged unsafe equipment, he shall inform his supervisor who shall have the responsibility to determine what action, if any, should be taken.
Unsafe Conditions. An employee shall not be disciplined for a good faith refusal to engage in or work in a situation which is allegedly life-threatening or presents the potential for serious injury or which is abnormal to his/her place of employment and/or position description, subject to any three (3) of the following conditions:

If an employee has justifiable reason to believe that his safety and health are in danger due to an alleged unsafe working condition, or alleged unsafe equipment, he shall inform his supervisor who shall have the responsibility to determine what action, if any, should be taken, including whether or not the job should be shut down.
Unsafe Conditions. When an employee has a reasonable basis to believe that the performance of an assigned task will subject him/her to serious injury or death, s/he may choose not to perform the task provided s/he has exercised all reasonable options, including consulting with his/her supervisor, when possible, and there is no reasonable alternative or solution to prevent risk of serious injury or death. In such cases, Management shall not interpret the actions of the employee as neglecting his/her duties and no retaliation of any kind, including disciplinary action, shall apply against the employee. In all cases, the employee shall report any unsafe or dangerous conditions to a supervisor immediately after confronting a dangerous or unsafe working condition.
Unsafe Conditions. Agent reserves the right to relocate Guest in the event that, in Agent’s sole discretion, an unsafe or potentially unsafe situation exists. Any additional costs shall be the sole responsibility of Guest.
