LESSOR'S SERVICES. (a) Lessor shall furnish the following services to Lessee at Lessor’s cost on and during each business day. (i) Daily janitorial service and supplies for the Premises, Monday through Friday, except on national holidays. (ii) Heating and air conditioning during the appropriate seasons at levels similar to those maintained in similar one-story office buildings during normal business hours (7:00 a.m. to 10:00 p.m. Monday through Friday and 7:00 a.m. to 2:00 p.m. Saturday). (iii) Hot and cold water as required for drinking, cleaning and lavatory purposes. (iv) Electricity supplied through the Building’s 110-volt 20 amp circuits for lighting purposes and for operation of small business machines and equipment (e.g., typewriters, adding machines, personal computers and similar equipment). If Lessee desires dedicated or 220-volt electrical circuits, or wishes to install electrical equipment which will cause usage of electricity within the Premises to be above normal electrical usage for general office space, Lessee shall obtain Lessor’s written consent prior to installing such equipment or circuits. Any additional electrical circuits approved shall be installed by Lessor at Lessee’s expense. (b) Lessor shall not be liable for the interruption of any of the above-mentioned services caused by strikes, lockouts, accidents or other causes beyond the reasonable control of Lessor. Any interruption of service shall never be deemed an eviction or disturbance of Lessee’s use and possession of the Premises or any part thereof, or render Lessor liable to Lessee for damages, or relieve Lessee from performance of Lessee’s obligation under this lease, unless the interruption is the result of gross negligence by Lessor. Lessor shall use its best efforts to restore the interrupted service within a reasonable time after interruption if the cause of interruption is subject to Lessor’s control. (c) Lessor shall also provide exterior maintenance of the Building and its appurtenant grounds and facilities (the “Project”), including, but not limited to, parking lot repairs, landscape maintenance, structural repairs and roof repairs. (d) Lessor shall make all necessary repairs to the Premises at its expense, except when the repairs are required as a result of misuse or neglect by Lessee or by persons under Lessee’s control or on the Premises at Lessee’s invitation, in which event, Lessee shall make such repairs at its own expense.

The Demised Premises are not separately metered, and LESSEE shall pay to LESSOR as required Additional Rent, LESSEE'S Proportionate Share of the cost of such services, which payment shall be due within ten (10) days after receipt of a statement therefor from LESSOR. Notwithstanding anything to the contrary contained in this Lease, LESSEE hereby expressly agrees and acknowledges that (i) LESSOR shall not be liable in any way to LESSEE (A) for drinkingany loss, cleaning and lavatory purposes.

At the option of LESSOR, LESSEE shall purchase from LESSOR all fluorescent lamps, light bulbs and ballasts used in the Demised Premises and pay LESSOR for the interruption cost of any of the above-mentioned services caused by strikes, lockouts, accidents or other causes beyond the reasonable control of Lessor. Any interruption of service shall never be deemed an eviction or disturbance of Lessee’s use and possession of the Premises or any part thereof, or render Lessor liable to Lessee for damages, or relieve Lessee from performance of Lessee’s obligation under this lease, unless the interruption is the result of gross negligence by Lessor. (c) Lessor LESSEE shall also provide exterior maintenance make no alteration to the existing electrical equipment or connect any fixtures, appliances or equipment thereto (other than electric typewriters, personal computers, calculators, desk lights, photocopy machines and other small, ordinary office equipment) without the prior written consent of LESSOR in each instance. Should LESSOR grant such consent, all additional risers or other equipment required therefor shall be provided by LESSOR and the Building and its appurtenant grounds and facilities (the “Project”), including, but not limited to, parking lot repairs, landscape maintenance, structural repairs and roof repairscost thereof shall be paid by LESSEE as Additional Rent upon LESSOR'S demand.
(d) Lessor 8.4. LESSOR shall make all necessary repairs not be liable to the Premises at its expenseLESSEE for any costs, except when the repairs are required expenses or damages incurred by LESSEE as a result of misuse any failure to furnish any service hereunder, or neglect any interruption of any utility service to the Demised Premises, and such failure or interruption (i) shall not be construed as a constructive eviction or eviction of LESSEE, (ii) shall not excuse LESSEE from failing to perform any of its obligations hereunder and (iii) shall not entitle LESSEE to any abatement or offset against Basic Rent or Additional Rent. LESSEE agrees that any service to be provided by Lessee LESSOR may be stopped and/or interrupted in connection with any inspection, repair, replacement or emergency.
8.5. The parties hereto shall comply with all mandatory and voluntary energy conservation controls and requirements imposed or instituted by persons under Lessee’s control the Federal, State or local governments and applicable to office and warehouse buildings, including, without limitation, controls on the permitted range of temperature settings, and requirements necessitating curtailment of the volume of energy consumption or the hours of operation of the Building. Any terms or conditions of this Lease that conflict or interfere with such controls or requirements shall be suspended for the duration of such controls or requirements. Compliance with such controls or requirements shall not be considered an eviction, actual or constructive, of LESSEE from the Demised Premises at Lessee’s invitation, in which event, Lessee and shall make such repairs at its own expensenot entitle LESSEE to terminate this Lease or to an abatement of any Basic Rent or Additional Rent.

(ca) Lessor shall also provide exterior maintenance LESSEE shall, at its sole cost and expense and prior to occupying any portion of the Building Demised Premises for the purpose of conducting business, cause the electricity for the lights and its appurtenant grounds outlets in the Demised Premises and for all heating, ventilating and air-conditioning systems servicing the Demised Premises and for all other equipment and facilities to be installed by LESSEE (including, without limitation, the “Project”Equipment) at the Premises to be separately metered, and LESSEE shall contract with, and shall pay all charges for such electricity to, the utility company supplying such electricity. As a supplement to, and not a limitation of, LESSEE’S obligations under the preceding sentence, with respect to any portion of the Demised Premises (whether it be an entire Stage or any other portion of the Demised Premises), includingLESSEE shall cause such portion of the Demised Premises to be separately metered for electricity in accordance with the preceding sentence on or before the date that LESSEE receives a certificate of occupancy or a temporary certificate of occupancy, but not limited toas the case may be, parking lot repairs, landscape maintenance, structural repairs and roof repairsfor such portion of the Demised Premises.
(d) Lessor shall make all necessary repairs to the Premises at its expense, except when the repairs are required as a result of misuse or neglect by Lessee or by persons under Lessee’s control or on the Premises at Lessee’s invitation, in which event, Lessee shall make such repairs at its own expense.

(iii) Hot 19.1.3 Public elevator service, by elevator serving the floor on which the Demised Premises are situated during regular hours of Business Days.
19.1.4 Furnish adequate hot and cold water as required for drinking, cleaning portions of the common areas of the Building for drinking and lavatory purposes.
(iv) Electricity supplied through the Building’s 110-volt 20 amp circuits for lighting purposes as may be required by Lessee and for operation of small business machines and equipment (e.g., typewriters, adding machines, personal computers and similar equipment). If Lessee desires dedicated or 220-volt electrical circuits, or wishes Lessee's kitchen to install electrical equipment which will cause usage of electricity within the Premises to be above normal electrical usage for general office space, Lessee shall obtain Lessor’s written consent prior to installing such equipment or circuits. Any additional electrical circuits approved shall be installed by Lessor Landlord. If the Lessee uses water for any other purpose, the Lessor, at Lessee’s 's expense, shall install meters to measure Lessee's consumption of cold water and/or hot water for such other purposes, as the case may be. The Lessee shall pay for the quantities of cold water and hot water shown on such meters, at Lessor's cost thereof, on the rendition of Lessor's bills therefor.
(b) Lessor shall not be liable for 19.1.5 Maintain a listing on the interruption of any Building Directory and a sign adjacent to the entrance to the demised premises of the above-mentioned services caused by strikes, lockouts, accidents or other causes beyond the reasonable control of Lessor. Any interruption of service shall never be deemed an eviction or disturbance name of Lessee’s use .
19.1.6 Provide and possession install initial and replacement fluorescent tubes, starters and ballasts.
19.1.7 Keep and maintain all portions of the Premises or any part thereofland on which the Building is constructed (the "Land") including all parking areas and the sidewalks, or render Lessor liable to Lessee for damagescurbs and passageways adjoining the parking areas in a clean and orderly condition, or relieve Lessee from performance free of Lessee’s obligation under this leasedirt, unless the interruption is the result of gross negligence by Lessor. Lessor shall use its best efforts to restore the interrupted service within a reasonable time after interruption if the cause of interruption is subject to Lessor’s controlrubbish, snow, ice and unlawful obstructions.
(c) Lessor 19.1.8 Provide maintenance and care of landscaped area.
19.1.9 The Lessor, at its expense, shall also provide exterior maintenance of keep, maintain and repair the Building and its appurtenant grounds fixtures, appurtenances, structural systems, systems and facilities (serving the “Project”)Demised Premises, includingin good working order, but not limited to, parking lot repairs, landscape maintenance, structural repairs condition and roof repairs.
(d) Lessor repair and shall make all necessary repairs to repairs, structural and otherwise, interior and exterior, as and when needed in or about the Premises at its expenseDemised Premises, except when for those repairs and replacements for which the repairs are required Lessee is responsible pursuant to any other provision of this Lease.

LESSEE shall give LESSOR’S managing agent sufficient advance notice of such requirement, which notice shall be given on or before 12:00 PM on the day (other than a Building Holiday) such extra service is required; provided, however, if such extra service is required during a Building Holiday, then such notice shall be given not later than 12:00 PM of the last day (other than a Building Holiday) preceding the Building Holiday on which such extra service is required. LESSEE agrees to pay to LESSOR, as Additional Rent, the cost of such extra service within fifteen (15) days after receipt of a statement for such extra service; the cost of such extra service shall be liable determined in accordance with LESSOR’S then current schedule of costs for the interruption of any Building service in question. Without limiting LESSOR’S right to increase its charge for after hours heating, ventilation and air conditioning service, LESSOR advises LESSEE that as of the above-mentioned services caused by strikesdate of this Lease, lockouts, accidents or other causes beyond the reasonable control of Lessor. Any interruption of its current charge for such service shall never be deemed an eviction or disturbance of Lessee’s use and possession of the Premises or any part thereofis $75.00 per hour for each floor, or render Lessor liable portion of a floor, to Lessee for damages, or relieve Lessee from performance of Lessee’s obligation under this lease, unless the interruption which such service is the result of gross negligence by Lessor. Lessor shall use its best efforts to restore the interrupted service within a reasonable time after interruption if the cause of interruption is subject to Lessor’s controlfurnished.
(ca) Lessor Subject to the provisions of this Section 9.3, LESSOR agrees to furnish to the Demised Premises the Standard Electric Service (as herein defined).
