Services by Landlord. As long as Tenant is not in default hereunder, Landlord agrees to furnish those services and utilities to the Premises, which are customarily provided to tenants in comparable suburban office buildings located in the West Fort Worth area, and which shall specifically include the services listed on Exhibit “G” (attached hereto and made a part hereof for all purposes). All of such services shall be provided at Landlord’s cost and expense during Normal Business Hours except as specifically provided to the contrary elsewhere in this Lease. Services provided at times other than during Normal Business Hours shall be at Tenant’s cost and expense, with such charges to be established by Landlord, in Landlord’s sole discretion, and reimbursed to Landlord on demand. Failure to any extent to furnish or any stoppage of said utilities and services resulting from any cause whatsoever (a “Service Failure”) shall not render Landlord liable in any respect for damages to either person, property or business, nor be construed as an eviction of Tenant, nor entitle Tenant to any abatement of rent, nor relieve Tenant from fulfillment of any covenant or agreement contained herein. Should any malfunction of the Building improvements or facilities (which by definition do not include any improvements or facilities of Tenant besides Building standard improvements) occur for any reason (a “Malfunction”), Landlord shall use reasonable diligence to repair same promptly, but Tenant shall have no claim for rebate or abatement of rent or damages on account of such Malfunction or of any Service Failure occasioned thereby or resulting therefrom. Any provision herein to the contrary notwithstanding, if a Malfunction or Service Failure results in the Premises or any material portion thereof not being reasonably usable by Tenant for its business purpose (“Untenantable”) (unless the Service Failure is caused by a fire or other casualty, in which event Paragraph 22 hereof controls) and same remains uncured for a total of 5 consecutive days after Landlord’s receipt of Tenant’s written notice of the Malfunction or Service Failure, Tenant shall have the following rights and remedies:
(a) Effective on the first day after the 5th consecutive day following such Malfunction or Service Failure, Tenant shall be entitled to an equitable abatement of Base Rental and Additional Rental commensurate to that portion of the Premises rendered Untenantable by the Malfunction or Service Failure calculated on a per s...
Services by Landlord. Landlord shall be responsible for providing for maintenance of the Building Common Area, and, except as required by Section 10(b) hereof or as otherwise specifically provided for herein, Landlord shall be responsible for no other services whatsoever. Tenant, by payment of Tenant’s share of the Operating Expenses, shall pay Tenant’s pro rata share of the expenses incurred by Landlord hereunder.
Services by Landlord. 10.01 Landlord shall furnish the following services to the Premises and the Parcel:
(a) Keep in operation in the Building a heating apparatus during such periods as same may be necessary to maintain an inside temperature at 70 degrees at a minimum outside temperature of 0 degrees dry bulb between the 15th day of October and the 1st day of May of each year and an air conditioning system during such periods as same may be necessary to maintain an inside temperature of 78 degrees when the outside temperature is at a maximum of 94 degrees dry bulb to be operated throughout the term of this Lease or any renewal hereof, between the hours of 8:00 a.m. to 6:00 p.m., Monday through Friday (Legal Holidays excepted as set forth in Exhibit "F"), subject, however, to governmental requirements. Landlord, at its cost, at the inception of this Lease, will furnish a light bulb or bulbs or fluorescent tube or tubes, as the case may be, and standard ballasts, for each lighting fixture then installed on the Premises. landlord shall provide and reserves the right to make reasonable additional charges, payable as Additional Rent, for services furnished at the request of Tenant on days or at times other than those above defined as provided in Section 6.04 (d). Notwithstanding the foregoing, Tenant shall have the right to enter and use the Premises at all hours and times in which event Tenant agrees to keep all outside doors locked.
(b) Furnish cold water (at the normal temperature of the water supply to the Building) to the Building for drinking and lavatory purposes and hot water (from the regular Building supply at prevailing temperatures) to the Building for lavatory purposes.
(c) Cause the Premises to be cleaned after normal business hours in accordance with the Cleaning Specifications as set forth in Exhibit "E".
(d) Make such repairs and replacements to the Premises as reasonably required (Tenant shall solely be responsible for the payment of the cost of same, if required, due to the negligence, misuse, abuse or willful misconduct of Tenant, its agents, servants or employees, invitees, subtenants, contractors or assigns).
(e) Provide window washing, landscaping, including lawn maintenance, snow removal from sidewalks, driveways and parking areas and directory board maintenance.
Services by Landlord. Landlord shall provide the Building Standard -------------------- Services described on Exhibit "E" attached hereto and by reference made a part ----------- hereof.
Services by Landlord. (a) So long, as Tenant continues to occupy the Premises and does not commit an event of default under this Lease, Landlord will furnish for the occupied portion of the Premises, at Landlord's expense, the following services during the Term: (1) heating and air at such temperatures and in such amounts as Landlord shall consider to be standard; (11) water for lavatory and toilet purposes at points of supply provided for the general use of tenants of the Building; (iii) Janitor and maid service on weekdays other than holidays and such window washing and wall cleaning as may in the judgment of Landlord be reasonably required (provided, however, if Tenant's leasehold improvements are of a different quality than is standard in the Building and, therefore, the cost of janitor and maid service for the Premises exceed the costs of Janitor and maid service for other premises in the Building with standard leasehold improvements, then Tenant will pay the excess cost as additional rent upon receipt of a statement therefor): (iv) elevator service to and from any floor(s) above the first floor on which the Premises are located during normal business hours (provided, however, that Landlord may limit the use of Building elevators for freight service to times other than normal business hours and to such times as Are scheduled through the manager of the Building)- and (v) electric lighting and routine maintenance for the Common Areas in the manner and to the extent Landlord deems reasonable and standard. Landlord will wash windows a minimum of once per year.
(b) So long as Tenant continues to occupy the Premises and does not commit an event of default under this Lease, Landlord will furnish sufficient power to the Premises for lighting and for typewriters, calculating machines and other machines of similar low electrical consumption, computer and/or electronic data processing equipment with higher electrical capacity requirements, but not for special lighting in excess of lighting that is standard in the Building, or any other item of equipment that requires electricity in excess of the amount Tenant currently uses. If Tenant requires electricity in excess of the electricity Landlord must furnish under the preceding sentence, Landlord, at Tenant's expense, will make a reasonable effort to meet Tenant's needs through the then existing feeders servicing the Building. Landlord, not Tenant, will install any supplemental risers or wiring to meet Tenant's excess electrical require...
Services by Landlord. While Tenant is occupying the Premises and is not in default under this Lease, Landlord shall, at its expense, but subject to the provisions of Articles 6 and 8 hereof, furnish the Premises with:
(a) passenger elevator service (where applicable) in common with other Tenants for access to and from the Premises, reasonably limited after normal business hours and on Saturdays, Sundays, and holidays;
(b) janitorial cleaning services as are customarily provided to Tenants in comparable office buildings in the greater Harrisburg area; and
(c) the utility services provided for in Article 8 below.
Services by Landlord. Landlord shall provide the Building Standard Services described on Exhibit "E" attached hereto and by this reference made a part hereof.
Services by Landlord. From and after the Lease Commencement Date, Landlord shall be responsible for providing no services to the Demised Premises whatsoever, except for the services for which Landlord is specifically obligated pursuant to Section 11(b) and Sections 18 (f) and (h).
Services by Landlord. Provided Tenant is not in default under this Lease, and subject to the conditions and standards set forth in this Lease and to standards, limitations and guidelines imposed by governmental authorities and utility companies, Landlord will furnish or cause to be furnished the following services and utilities: (i) heat and air conditioning to the Premises to maintain a comfortable temperature range between 70° and 76 ° on a year round basis during “Normal Business Hours” (as defined in the Rules and Regulations), (ii) water at the normal temperature of the supply of water to the Building for lavatory and drinking purposes through fixtures installed by Landlord or by Tenant with Landlord’s consent; (iii) janitorial cleaning services to those portions of the Premises which are used for office purposes five (5) days per week (except on holidays observed by the Building – See Exhibit D Rules and Regulations for a list of Federal Holidays observed); (iv) twenty-four (24) hour, nonexclusive passenger elevator service and, when scheduled through the Building management, nonexclusive freight elevator service to the floor(s) on which the Premises are located; (v) routine maintenance in the Common Areas; (vi) replacement of standard light bulbs, fluorescent tubes, and ballasts in the Premises; and (vii) electric current to the Premises for standard office lighting and office machines which consume electric current within the parameters set forth in Section 5.3(a)(i) of this Lease. Xxxxxxxx, at his sole discretion, may elect to reduce the number of janitorial visits per week from five (5) per week to three (3) per week. This reduction in weekly service may be performed to decrease operating expenses and to implement a more energy efficient policy. Individual conditions will be addressed as necessary.
