Lessor’s Right to Repair. If Lessee fails to perform Lessee’s maintenance and repair obligations, after ten (10) business days’ prior written notice to Lessee, except in an emergency when no notice will be required, Lessor may enter the Premises, perform the obligations on Xxxxxx’s behalf, and recover the cost of performance, together with interest at the rate of twelve percent (12%) per year, as Additional Rent payable by Lessee with the next installment of Base Rent, as long as that rate does not exceed the maximum rate then allowed by Law.
Lessor’s Right to Repair. If Lessee shall fail, refuse or neglect to make any repairs in accordance with the terms of this Lease, Lessor shall have the right, but not the obligation, after five days' written notice to Lessee, to make such repairs for the account of Lessee and to enter upon the demised premises for such purposes, and Lessee agrees to pay the cost and expenses thereof, plus a reasonable fee for Lessors' overhead, after receipt of a xxxx therefor from Lessor, with the next installment of fixed rent coming due.
Lessor’s Right to Repair. If the Lessee does not carry out reasonable repairs, the Lessor may carry out those repairs at the expense of the Lessee.
Lessor’s Right to Repair. If the Lessee does not make repairs promptly and adequately, or fails to maintain the Premises in good repair, Lessor may, but shall not be required to make repairs upon ten (10) days notice to Lessee, and Lessee shall pay promptly the reasonable cost thereof, as additional rent, on the next rent date thereafter. Lessor shall have a right of entry upon the Premises for such purposes. Lessee agrees that "reasonable cost" as used in this Paragraph 9, shall mean Lessor's out-of-pocket costs plus twenty percent (20%) to cover overhead, administrative and collection charges. Lessee shall, upon the termination of this Lease, surrender the Premises to Lessor, in the same condition as when received or when first installed, except for ordinary wear or for damage covered by Lessor's fire and extended coverage insurance. There shall be no abatement of rent and no liability of Lessor by reason of any injury to or interference with Lessee's business arising from the making of any repairs, alterations, or improvements in or to any portion of the premises or building, common area, or to fixtures, appurtenances, and equipment therein. 9.3
Lessor’s Right to Repair. In the event Lessee fails to perform Lessee's repair and maintenance obligations as herein provided, Lessor shall give Lessee notice to do such acts as are reasonably required to repair or maintain the Premises. If Lessee fails to do the work within thirty (30) days of said notice, or fails to diligently supervise completion of the work within that time, then Lessor shall have the rights (but not the obligation) to do such acts and expend such funds as are reasonably required to perform such work. Any amounts so expended by Lessor shall be paid by Lessee promptly after demand, with interest from the date expended by Lessor at the lower of: (i) the maximum rate permitted by law; or (ii) the annual rate of eight percent (8%), compounded annually, such interest rate to go into effect the fifteenth (15th) day after written demand from the Lessor. Lessor shall reasonably coordinate such maintenance with Lessee to minimize any interference with the use of the Premises by Lessee.

  • Lessor’s Right to Inspect Lessee shall permit Lessor and its authorized representatives as frequently as reasonably requested by Lessor to inspect the Leased Property and Lessee’s accounts and records pertaining thereto and make copies thereof, during usual business hours upon reasonable advance Notice, subject only to any business confidentiality requirements reasonably requested by Lessee.

No such entry shall be deemed an eviction of the Lessee. All sums so paid by the Lessor and all costs and expenses (including, without limitation, reasonable attorneys' fees and expenses, in each case, to the extent permitted by law) so incurred shall be paid by the Lessee to the Lessor on demand as an Additional Charge. The obligations of the Lessee and rights of the Lessor contained in this Article shall survive the expiration or earlier termination of this Lease.

  • LESSOR'S RIGHT TO PERFORM If Lessee fails to make any payment required to be made by it hereunder or fails to perform or comply with any of its other agreements contained herein, Lessor may itself make such payment or perform or comply with such agreement, after giving not less than five Business Days' prior notice thereof to Lessee (except in the event that an Indenture Default resulting from a Lease Default or a Lease Event of Default shall have occurred and be continuing, in which event Lessor may effect such payment, performance or compliance to the extent necessary to cure such Indenture Default with notice given concurrently with such payment, performance or compliance), but shall not be obligated hereunder to do so, and the amount of such payment and of the reasonable expenses of Lessor incurred in connection with such payment or the performance of or compliance with such agreement, as the case may be, together with interest thereon at the Late Rate from such date of payment, to the extent permitted by applicable law, shad be deemed to be Supplemental Rent, payable by Lessee to Lessor on demand.

  • Lessor's Right to Cure Lessee's Default If Lessee fails to make any payment or to perform any act required to be made or performed under this Lease, including, without limitation, Lessee’s failure to comply with the terms of any Franchise Agreement, and fails to cure the same within the relevant time periods provided in Section 16.1, Lessor, without waiving or releasing any obligation of Lessee, and without waiving or releasing any obligation or default, may (but shall be under no obligation to) at any time thereafter make such payment or perform such act for the account and at the expense of Lessee, and may, to the extent permitted by law, enter upon the Leased Property for such purpose and, subject to Section 16.4, take all such action thereon as, in Lessor’s opinion, may be necessary or appropriate therefor. All sums so paid by Lessor and all costs and expenses (including, without limitation, reasonable attorneys’ fees and expenses, in each case to the extent permitted by law) so incurred, together with a late charge thereon (to the extent permitted by law) at the Overdue Rate from the date on which such sums or expenses are paid or incurred by Lessors, shall be paid by Lessee to Lessor on demand. The obligations of Lessee and rights of Lessor contained in this Article shall survive the expiration or earlier termination of this Lease.

  • LANDLORD'S RIGHT TO INSPECT Tenant shall permit Landlord and its authorized representatives to inspect the Leased Property, or any portion thereof, during usual business hours upon not less than forty-eight (48) hours’ notice and to make such repairs as Landlord is permitted or required to make pursuant to the terms of this Agreement, provided that any inspection or repair by Landlord or its representatives will not unreasonably interfere with Tenant’s use and operation of the Leased Property and further provided that in the event of an emergency, as determined by Landlord in its reasonable discretion, prior Notice shall not be necessary.

  • LESSOR'S RIGHT OF ENTRY The Lessor or the Lessor's agent may enter at reasonable hours to inspect or show the Premises to prospective lenders and purchasers, and to do anything the Lessor may be required to do hereunder or which the Lessor may deem necessary for the good of the Premises or any building of which they are apart. During the last [#] days of the Term, the Lessor may display a "For Rent" sign on the Premises and show the Premises to prospective lessees.

  • Landlord’s Right to Enter Landlord and its agents shall have the right to enter the Leased Premises during normal business hours after giving Tenant reasonable notice and subject to Tenant’s reasonable security measures for the purpose of (i) inspecting the same; (ii) showing the Leased Premises to prospective purchasers, mortgagees or tenants; (iii) making necessary alterations, additions or repairs; and (iv) performing any of Tenant’s obligations when Tenant has failed to do so. Landlord shall have the right to enter the Leased Premises during normal business hours (or as otherwise agreed), subject to Tenant’s reasonable security measures, for purposes of supplying any maintenance or services agreed to be supplied by Landlord. Landlord shall have the right to enter the Outside Areas during normal business hours for purposes of (i) inspecting the exterior of the Building and the Outside Areas; (ii) posting notices of nonresponsibility (and for such purposes Tenant shall provide Landlord at least thirty days’ prior written notice of any work to be performed on the Leased Premises); and (iii) supplying any services to be provided by Landlord. Any entry into the Leased Premises or the Outside Areas obtained by Landlord in accordance with this paragraph shall not under any circumstances be construed or deemed to be a forcible or unlawful entry into, or a detainer of, the Leased Premises, or an eviction, actual or constructive of Tenant from the Leased Premises or any portion thereof.

  • Landlord’s Right To Mortgage Tenant agrees to accept the premises subject to and subordinate to any existing or future mortgage or other lien, and Landlord reserves the right to subject premises to same. Tenant agrees to and hereby irrevocably grants Landlord power of attorney for Tenant for the sole purpose of executing and delivering in the name of the Tenant any document(s) related to the Landlord’s right to subject the premises to a mortgage or other lien.
