Common use of Level Two – Written Notice of Unprofessional Conduct or Unsatisfactory Performance Clause in Contracts

Level Two – Written Notice of Unprofessional Conduct or Unsatisfactory Performance. If the unit member has failed to correct, within the agreed upon time period, the unprofessional conduct that had led to a Level One disciplinary action; or if the unit member, within two years of the initial occurrence, repeats a behavior that had previously resulted in a Level One disciplinary action, the Vice President for Academic Services or the Vice President for Student Services, as appropriate, shall issue a Written Notice of Unprofessional Conduct or Unsatisfactory Performance. The Written Notice shall document the exact nature of the unprofessional or unsatisfactory conduct, including details of specific incidents that are being judged as unsatisfactory. The Written Notice shall document the previous Verbal Warning and the outcome of the Level One disciplinary action. The Written Notice will list the exact correction expected, the time period in which this correction is to take place, and the further discipline that will occur if the correction does not take place. The time period for correction must be at least ninety (90) days (Ed. Code §87734). The Written Notice will be hand delivered to the unit member by the Vice President, or alternatively sent by certified mail to the address the District has on file for the unit member. A copy of the Written Notice will be placed in the unit member’s personnel file in the Human Resources office. The unit member may respond to the Written Notice as follows:
