Liability for data loss. In the case of lost data or damage to data, Accenture's liability shall be limited to compensation for costs resulting from the restoration of data using electronic backup media. The Client’s obligation to perform regular data backup according to the state of technology shall not be affected.

  • Liability for Damages 1. The Purchaser shall be liable for any damages sustained by the State arising from Purchaser’s breach of the terms of this Contract and the State may cause all or part of the performance bond to be forfeited to recover such damages.
