Common use of Liability for Out-of-Specification Gas Clause in Contracts

Liability for Out-of-Specification Gas. (a) The Service Provider will not be responsible for, and the Shipper releases the Service Provider from any liability in respect of, any Loss (including Direct Loss and Consequential Loss) suffered or incurred by the Shipper arising out of the delivery or deemed delivery by the Service Provider of Out-of-Specification Gas. (b) If any Out-of-Specification Gas supplied by the Shipper enters the Pipeline, then the Shipper will be in breach of this document and, despite any other provision of this document and without prejudice to any other right or remedy which the Service Provider may have in respect of that breach, the Shipper indemnifies the Service Provider against all Losses (including Direct Loss and Consequential Loss) suffered or incurred by the Service Provider as a result of or in connection with the delivery of Out-of-Specification Gas, including any Loss incurred by the Service Provider: (i) in respect of any Claims made by third parties as a result of the delivery of Out-of-Specification Gas; or (ii) arising out of or connected to the cleaning or rectifying of the Pipeline and related infrastructure.
