LIABILITY FOR SECURITY DEPOSIT. In the event of a transfer of the Landlord’s interest in the Premises or this Lease, Landlord shall deliver to the transferee or assignee (in cash or by credit) any unused Security Deposit held by Landlord. Upon such transfer or assignment and delivery of the Security Deposit, if any, Landlord shall be relieved of all liability with respect to the obligations and/or covenants under this Lease thereafter to be performed by the same.
LIABILITY FOR SECURITY DEPOSIT. Xxxxxx agrees that the holder of any mortgage covering the Premises shall not, under any circumstances, be liable for such Security Deposit. In the event of a sale of the Shopping Center, Landlord shall deliver said Security Deposit to the purchaser and thereupon the transferring Landlord shall be discharged from any further liability with respect to the Security Deposit and the purchaser shall retain said Security Deposit as Landlord under this Section.
