Licensing Act 2003 provides a clear focus on the promotion of the licensing objectives; introduces better and more proportionate regulation to give customers more choice, whilst providing the necessary protection for local residents and others.
Licensing Act 2003. The Braunstone Civic Centre and the Xxxxxx Astley Community Centre are Licensed for the sale by retail of alcohol. The Operator will need to obtain the necessary licences and approvals for the following activities in the Bar/Café at Braunstone Civic Centre:- - A performance of live music - Any playing of recorded music - A performance of dance - Entertainment of similar description to that falling within a performance of live music, any playing of recorded music or a performance of dance - Entertainment facilities for making music - Entertainment facilities for dancing - Entertainment of a similar description to that falling within entertainment facilities for making music or dance The Operator will meet the following requirements:-
i) Hold a ‘Personal Licence’ under Section 117 of the Licensing Act 2003.
ii) Be designated ‘Premises Supervisor’ in accordance with the Act and ensure that conditions attached to both premises licences are complied with at all times.
iii) Ensure that sufficient Bar/Security staff are employed for the preservation of order in the Bars, function rooms and public areas. If, for any reason, the Operator is refused a ‘Personal Licence, under Section 17 of the Licensing Act 2003, he/she will immediately advise the Town Council’s Executive Officer & Town Clerk.
Licensing Act 2003. 6.1. Under The Licensing Act 2003 the Hirer shall ensure that he contacts the Council’s Environmental Services Division, to seek advice as required.
6.2. A licence issued by the Council’s Environmental Services Division, shall be required for Events with 500 people or more, and involving any of the following activities: The sale or supply of alcohol The provision of entertainment The showing of films or plays All indoor sporting Events Outdoor boxing or wrestling matches The performance or playing of live or recorded music Performances of dance or the provision for dancing or music making The supply of any hot food or drink between 11pm and 5am
6.3. The Hirer shall ensure that his licence application is submitted to Environmental Services, at least 3 months prior to the Event.
6.4. The Hirer shall seek the prior permission of the OIC to have alcohol or entertainment at his Event.
6.5. The Hirer shall ensure that he informs the Inspector of the Events Police Support Service or his appointed representative, of his intention to supply or sell alcohol.
6.6. The Hirer shall ensure that all beverages are decanted into plastic drinking containers. Permission to use glass containers shall be sought from the OIC prior to the Event.
6.7. The Council accepts no responsibility or liability for the cancellation of the Event due to the refusal of a Licence.
