The Hirer Sample Clauses

The Hirer a Shall provide all information Cabins to Rent reasonably requires to complete a Financing Statement or Financing Change Statement as those terms are defined in the PPSA in relation to the Cabin; and b Waives the right to receive a verification statement confirming registration of a Financing Statement or a Financing Change Statement relating to the security interest created by this Agreement.

The Hirer. The Hirer, not being a person under 21 years of age, agrees to be present during the hire or be represented by an authorised person and to comply fully with this Hire Agreement. Furthermore, the Hirer, or their representative, hereby accepts responsibility for being in charge of and on the premises at all times when the public are present and for ensuring that all conditions, under this Agreement, relating to management and supervision of the premises are met.
The Hirer a) Is responsible for any damage caused to tyres and tubes (fair wear and tear excepted) b) Is responsible for breakages to windscreens or windows c) Is responsible for all damage d) Shall have exclusive possession, use and control of the Vehicle for the duration of the Agreement and the Hirer shall assume exclusive responsibility to the public and any regulatory body having jurisdiction e) Undertakes to drive and use the Vehicle in a skilful and careful manner at all times f) Is responsible where supplied for all spare wheels, tyres, batteries, battery chargers and fuel cans and any loss or damage will be charged for g) Is responsible for keeping secure all sets of keys, lost or stolen keys may result in the vehicle locks being replaced and all associated costs will be the responsibility of the Hirer.
The Hirer. (a) and the OWNER agree and acknowledge that by virtue of this Agreement: and the hire or bailment of the equipment, a PPS lease Security Interest is granted by the HIRER to the OWNER under the PPSA in the equipment, and (b) agrees to do anything that the OWNER reasonably requires to ensure that the OWNER has at all times a continuously perfected security interests over all of the equipment for the purposes of the PPSA.
The Hirer. 1.1 The Hirer is the person (whether acting as an individual or not) completing the hire booking for the Facilities. 1.2 The person with overall responsibility for the hire of the pool must sign two copies of the Hire Agreement Form. Hirers will also be provided with a copy of the Normal Operating Procedures (NOP) and Emergency Operating Procedures (EOP). 1.3 One member of the Users, who will be present throughout the period of hire, must be certified as trained in resuscitation and emergency first aid. Evidence to support such training should be made available to the Sandside Lodge Aquatic Pool Aquatic team at time of booking.
The Hirer. 1.1 The Hirer is the person (whether acting as an individual) hiring the Facilities. 1.2 The Hirer must be over 18 years of age. 1.3 The Hirer is responsible for the safety of the Users throughout the Hire Period. The Written Operating Procedures attached to these Conditions of Hire must be adhered to. 1.4 Two members of the party who will be present during the period of hire must hold a current First Aid or Life Support qualifications (First Aid: Public First Aid Certificate, First Aid at Work Certificate or Emergency First Aid Certificate) as set out in the Written Operating Procedures and must allow the Findon Swimming Pool Committee to inspect these certificate(s) at time of booking and thereafter upon request.
The Hirer. Will be responsible for reimbursing Xxxxxxxxx Community Centre for any damage incurred accidentally or otherwise to the building and its contents during the period of hire, no matter how or by whom committed, and additionally to include damage immediately prior to and after the period of hire, by those attending the event.

The Hirer. (a) must at all times during the Term have a COVID Safe Plan; (b) must ensure that the Use Area is kept clean and tidy, and immediately clean any spillage or waste matter; (c) must avoid any noise or action which may interfere with the activities of UCA, other users of the Property or persons in neighbouring properties; (d) must leave the Use Area (and any other part of the Property for which the Hirer has been provided keys) securely closed and locked with all lights, heaters and other appliances turned off and all furniture returned to its usual locations, or as otherwise directed by UCA from time to time; (e) must comply with all directions and instructions reasonably given by UCA; (f) conduct themselves, and ensure Attendees conduct themselves, in accordance with the Property Details and Code of Conduct and the reasonable direction of UCA, and avoid any conduct which is contrary to UCA’s mission, reputation or activities in the community; (g) must provide adequate and responsible supervision to ensure the safety of the Use Area and the Property and all Attendees; (h) must avoid any action (and ensure Attendees avoid any action) that may cause or result in damage to the Use Area or Property; (i) must ensure that the Permitted Use is undertaken in compliance with all applicable standards, awards, laws and regulations (including but not limited to the Child Safe Standards as outlined in the Children’s Guardian Act NSW 2019); and (j) agrees and acknowledges that it is the responsibility of the Hirer to protect at all times any personal property that they or any Attendees may bring onto the Property .
The Hirer. (a) Acknowledges this agreement is a Security Agreement for the purposes of the PPS Act; (b) Consents to Council registering its security interest on the PPSR; (c) Consents to Council applying any monies received, firstly, against its costs and disbursements in recovering such monies on a full indemnity basis, secondly against any interest accrued and finally against any amount due; and (d) Agrees to the debiting of its account with Council of the cost of registration of Council's security interest and all other associated costs with perfection and enforcement of such security interest on an indemnity basis.
The Hirer. (a) Waives their rights under s157 of the PPSA to received a verification statement about the creation of a security interest under this document; (b) Agrees that to the extent permitted by the PPSA, the following sections of the PPSA will not apply and hereby contracts out of them to the extent stated: (i) s95 (to the extent it requires the secured party to give notices to the grantor) (ii) s118 (to the extent that it allows a secured party to give notices to the grantor); and (iii) sections 95,121(4), 125, 130, 132(3)(d), 132(4), 135, 142 & 143 (c) Agrees that the following sections of the PPSA will not apply that the Hirer will have no rights under those sections: sections 127, 129(2), 129(3), 130(1), 132, 134(2), 135, 136(3), 136(4), 136(5) and 137.
