Liens for Unpaid Assessments. Except as otherwise provided in N.J.S. 46:8B-21, any lien for an Annual Assessment shall be subordinate to any lien for past due and unpaid taxes and any institution’s first mortgage lien (hereinafter a “first mortgage”) or mortgages now or hereafter placed upon any Unit, provided, however, that such subordination shall apply only to the sale or transfer of any such Unit pursuant to a decree of foreclosure, or any proceeding in lieu of foreclosure. Any such liens shall be governed by the provisions in N.J.S. 46:8B-21. Such sale or transfer shall not relieve any such Unit from liability for any Annual Assessment thereafter becoming due, nor from the lien for any such subsequent Annual Assessment. Liens for unpaid Annual Assessments may be foreclosed by suit brought in the name of the Association in the same manner as a foreclosure of a mortgage on real property. A suit to recover a money judgment for unpaid Annual Assessments may also be maintained without waiving the lien securing same.

  • CANCELLATION ASSESSMENTS UCF DHRL will charge fees and/or assessments if this agreement is cancelled by action of the Student or UCF DHRL. The amount of the cancellation assessment is not a penalty, but liquidated damages to compensate UCF DHRL for lost rental revenue, additional administrative costs, and lost opportunity costs arising from and related to the cancellation of the agreement. Cancellation assessments are due and payable upon the date the cancellation request is submitted to UCF DHRL.
