Neither the Borrower nor any of its Subsidiaries has outstanding any Lien except (i) as permitted by Section 5.3, and (ii) certain mechanic’s liens for a property located in Idaho (“Idaho Mechanic’s Liens”) for which Borrower intends to obtain releases using a portion of the proceeds of the Loans.
