Common use of Limitation on Password Use Clause in Contracts

Limitation on Password Use. Participants, Subscribers, and Authorized Affiliates of Participants that utilize the MLS system shall not furnish, disclose or permit the use of their MLS passwords and/or MLS access codes to any person, firm, company or other entity. In the event the password of a Participant or Subscriber is used in violation of Section 4.5, such Participant or Subscriber shall be liable to Central Texas MLS for all loss or damage caused by such use and shall be subject to a fine as de- scribed in Central Texas MLS’s Schedule of Fees, as may be updated from time to time, for each such entry and other sanctions as provided in these Rules and Regulations. The fact that the Participant or Subscriber did not grant consent to the use of the password shall not be a defense.
