Limitation on Publication. The Contractor shall not publish or submit for publication any article, press release, or other writing relating to the Contractor's services for the Judicial Council without prior review and written permission by the Judicial Council.

Judicial Council’s Obligation Subject to Availability of Funds Judicial Council Obligations Regarding Funding the Agreement. It is understood and agreed that the Judicial Council’s obligations under this Agreement are subject to the availability of authorized and appropriated funds. In the event that the Legislature fails to appropriate funds for this Agreement, the Judicial Council may, at its sole discretion, terminate the Agreement or any part of the Work pursuant to a termination for convenience as specified in this Agreement without prejudice to any rights or remedies under the Agreement or at law. An event of default shall not occur if the Judicial Council is unable to make any payments due under the Agreement because of the State of California’s failure to timely approve and adopt a State budget. If the Judicial Council fails to make any payments as a result of the State of California’s failure to timely approve and adopt a State budget, the Judicial Council shall promptly pay any previously due and unpaid payments upon approval and adoption of the State budget. Payment. Payment shall not exceed the amount allowed under the legislative appropriation. Funding for this Agreement. Funding for this Agreement beyond the current appropriation year is conditional upon appropriation by the Legislature of sufficient funds to support the activities described in this Agreement. Notice
