Limitations of the Contractor's Obligation. If this section is in, or is in 479 connection with, a contract relative to the design, planning, construction, alteration, repair 480 or maintenance of a building, structure, highway, road, appurtenance or appliance, 481 including moving, demolition and excavating connected therewith, then subsection 482 “13.1” above shall not require the Contractor to indemnify or hold harmless Indemnitees 483 against liability for damages arising out of bodily injury to persons or damage to property 484 proximately caused by or resulting from the negligence, in whole or in part, of 485 Indemnitees. 486
