Limitations on Transactions. How an EFT May Affect Your Account Balance We may charge or restrict your Designated Account for a debit EFT at the time you authorize the transaction, at the time we receive notice of the transaction or on the day the transaction is presented to us for payment, whichever is earlier. We count a transaction as having occurred when it is received by us in the Pacific time zone at local time. We may place a hold on your account for the amount of the transaction, which will reduce the available balance in the account. This hold may differ from the amount of the transaction that is charged to your account. If we place a hold on your account and the transaction is charged to your account before the hold expires, the available balance in the account may be reduced by the amount of the transaction as well as the amount of the hold. We are not responsible or liable to you if a transaction is rejected, declined or otherwise not processed to your account because a hold placed on a prior transaction has not expired, or if the amount of the hold placed for a reported transaction exceeds the amount of the actual transaction charged to your account. Limitations on Dollar Amounts of Transfers We may establish daily or other limits on the number and dollar amount of transactions that you may originate by use of your Check Card, ATM Card, or our City National Online or Mobile Banking services. Your CNB Check Card and ATM Card limits will be disclosed to you separately. We may change these limits from time to time. Transaction amounts conducted using your Check Card or your ATM Card are limited to the available balance in your Designated Account plus your available overdraft protection, if any, and are subject to further limitations as stated below. We reserve the right to limit the dollar amount of City National Online and Mobile Banking EFTs, including bill payments. See the City National Online® Access Agreement & Disclosure and Mobile Banking Services End User Agreement. Limitations on Types and Frequency of Transfers  You shall not use our EFT services for any illegal transaction, including, but not limited to, illegal Internet gambling.  You may not use our EFT services to initiate transactions to or in certain countries where, by reason of federal law or regulation, restrictions apply to monetary transactions conducted in or through the country. Transactions you attempt to conduct in such countries may be blocked. When planning to travel abroad, you may call us at (000) 000-0000 to determine the countries where restrictions currently apply.  We reserve the right to limit the types and frequency of City National Online and Mobile Banking EFTs. See the City National Online® Access Agreement & Disclosure and Mobile Banking Services End User Agreement.  Federal regulations limit the total number of the following types of withdrawals or transfers from a savings or money market account to six (6) per monthly statement period: • Check • Overdraft protection transfer • Debit card or ATM card purchase or payment • Preauthorized transfer to another payee or institution, including ACH or wire transfer • City National Online, Business Online, Treasury Net, or EASI Link payment or transfer • Mobile Banking payment or transfer • Automatic transfer to another City National Bank deposit account • Telephone transfer There is no limit to the number of the following types of transactions: • In-person transaction • Transaction made at an ATM • Automatic transfer to make a City National Bank loan payment • Deposit of any kind into account For more information on this transaction limitation and any fees associated with exceeding the limitation, refer to our Fee Schedule. Also tell us immediately if any of your accounts have been accessed or an EFT has occurred without your permission. Telephoning is the best way of keeping your possible losses down. Limitations on Transactions. How Cash Withdrawals Using your Card, you may withdraw up to your withdrawal limit from any combination of designated Accounts each day.If the available funds in any designated Account total less than the approved daily withdrawal limit, then onlythe lesser amount can be withdrawn. At any time, you may provide written request to us that your withdrawal limit be lowered to as little as $50.00 per day. In the case of POS transactions, you may choose to withdraw an EFT May Affect Your amount of funds that exceeds the amount of your purchase; however, Merchants who honor POS transactions may also set their own cash-back limits or refuse to honor cash- back transactions. Availability of Funds When you do not have available funds in your Account, including your Account Balance Overdraft Protection or Overdraft Line of Credit, if any, to cover a transaction, we considerthe transaction an Insufficient Fundsitemand will returnthe transaction unpaid. If use of your Card results in an overdraft on your Account, you agree to immediately repay us the amount of the overdraft and any Paid Item and/or Returned Items fee. You will be charged a Returned Item Fee each time we return unpaid for a non-sufficient available balance an item that is presented for payment, even if that item has previously been presented and returned for a non-sufficient available balance and you were previously charged a Returned Item Fee for that return. Further, you will be charged a Paid Item Fee if we honor or pay the item or transaction when you have a non-sufficient available balance even if you were previously charged Returned Item Fees when the item or transaction was previously returned, rejected, or declined. We have no obligation to notify you if we honor, pay, return or decline an item or transaction for a non-sufficient available balance. Other Limits We may also limit or refuse to complete your transaction for security reasons or while the terminalis being serviced. Advisory Against Illegal Use Youagree not to use your Card for illegal gambling or other illegal purposes. Display of a payment card logo by, for example, an online merchant does not necessarily mean that transactions arelawful in all jurisdictions in which the cardholder may be located. Electronic Banking Fees We may charge fees for electronic banking services to your deposit Account. The fees are listed in the Account Disclosure and Service Fees. For savings and money market Accounts, we charge an Excess TransactionFeefor each transaction thatexceedsthe number of limited transactions you may make each statement period. Surcharge or restrict your Designated Account for Convenience Fees by Others In addition to the fees set forth in our Service Fees schedule, there may be other fees associated with performing certain transactions at ATMs or POS terminals not owned or operated by us. These other fees are not assessed by us and will not be waived. We are a debit EFT member of the SUM Program, which means that a surcharge or convenience fee will not be charged if you use an ATM with the SUM symbol. Documentation of Transfers Terminal Transfers: You can get a receipt at the time you authorize the transaction, make any transfer to or from your Account using an ATM or POS terminal. Direct Deposit: If you have arranged to have direct deposits made to your Account at the time we receive notice of the transaction or on the day the transaction is presented to us for payment, whichever is earlier. We count a transaction as having occurred when it is received by us in the Pacific time zone at local time. Also tell us immediately if any of your accounts have been accessed or which indicates that an EFT has occurred without was made will be admissible as evidence of such transfer and will constitute prima facie proof that such transfer was made. Stopping Preauthorized Payments The initiation by you of certain electronic fund transfers from your permissionAccount will effectively eliminate your ability to stop payment of the transfer. Telephoning is the best way of keeping your possible losses downUNLESS OTHERWISE PROVIDED IN THIS AGREEMENT, YOU (THE CONSUMER) MAY NOT STOP PAYMENT OF ELECTRONIC FUND TRANSFERS.
