Common use of LIMITATIONS UNDER CRAF Clause in Contracts

LIMITATIONS UNDER CRAF. Notwithstanding the provisions of Section 15.1, during any period that the Aircraft, Airframe or any Engine is subject to CRAF in accordance with the provisions of Section 7.2.3 and in the possession of the U.S. Government, Lessor shall not, as a result of any Lease Event of Default, exercise its remedies hereunder in such manner as to limit Lessee's control under this Lease (or any Permitted Sublessee's control under any Permitted Sublease) of the Aircraft, Airframe or such Engine, unless at least 30 days' (or such other period as may then be applicable under CRAF) written notice of default hereunder shall have been given by Lessor or Mortgagee by registered or certified mail to Lessee (and any Permitted Sublessee) with a copy to the Contracting Officer Representative or Representatives for the Military Airlift Command of the United States Air Force to whom notices must be given under the contract governing Lessee's (or any Permitted Sublessee's) participation in CRAF with respect to the Aircraft, Airframe or any Engine.

LIMITATIONS UNDER CRAF. Notwithstanding the provisions of Section ss. 15.1, during any period that the Aircraft, Airframe the Airframe, or any Engine is subject to CRAF in accordance with the provisions of Section ss. 7.2.3 and in the possession of the U.S. Government, Lessor shall not, as a result of any Lease Event of Default, exercise its remedies hereunder in such manner as to limit Lessee's control under this Lease (or any Permitted Sublessee's control under any Permitted Sublease) of the Aircraft, Airframe the Airframe, or such Engine, unless Lessor gives at least 30 days' (or such other period as may then be applicable apply under CRAF) written notice of default hereunder shall have been given by Lessor or Mortgagee by registered or certified mail to Lessee (and any Permitted Sublessee) with a copy to the Contracting Officer Representative or Representatives for the Military Airlift Command of the United States Air Force to whom notices must be given under the contract governing Lessee's (or any Permitted Sublessee's) participation in CRAF with respect to the Aircraft, Airframe the Airframe, or any Engine.

LIMITATIONS UNDER CRAF. Notwithstanding the provisions of Section 15.1this Article IV, during any period that the Aircraft, an Airframe or any Engine is subject to CRAF in accordance with the provisions of Section 7.2.3 3.02(b)(vi) and in the possession of the U.S. Government, Lessor the Administrative Agent shall not, as a result of any Lease Event of Default, exercise its remedies hereunder in such manner as to limit Lessee's the Borrower’s control under this Lease Mortgage (or any Permitted Sublessee's Lessee’s control under any Permitted SubleaseLease) of the Aircraft, Mortgage and Security Agreement such Airframe or such Engine, unless at least 30 60 days' ’ (or such other period as may then be applicable under CRAF) written notice of default hereunder shall have been given by Lessor the Administrative Agent or Mortgagee any Secured Party by registered or certified mail to Lessee the Borrower (and any Permitted SublesseeLessee) with a copy to the Contracting Officer Representative or Representatives for the Military Airlift Command of the United States Air Force to whom notices must be given under the contract governing Lessee's the Borrower’s (or any Permitted Sublessee'sLessee’s) participation in CRAF with respect to the Aircraft, such Airframe or any Engine.

Notwithstanding the provisions of Section 15.1this Article IV, during any period that the Aircraft, Airframe or any Engine is subject to CRAF in accordance with the provisions of Section 7.2.3 3.02(b)(vi) and in the possession of the U.S. Government, Lessor the Collateral Agent shall not, as a result of any Lease Event of Default, exercise its remedies hereunder in such manner as to limit Lessee's the Company’s control under this Lease Mortgage (or any Permitted Sublessee's Lessee’s control under any Permitted SubleaseLease) of the Aircraft, Airframe or such Engine, unless at least 30 days' ’ (or such other period as may then be applicable under CRAF) written notice of default hereunder shall have been given by Lessor the Collateral Agent or Mortgagee any other Secured Party by registered or certified mail to Lessee the Company (and any Permitted SublesseeLessee) with a copy to the Contracting Officer Representative or Representatives for the Military Airlift Command of the United States Air Force to whom notices must be given under the contract governing Lessee's the Company’s (or any Permitted Sublessee'sLessee’s) participation in CRAF with respect to the Aircraft, Airframe or any such Engine.

Notwithstanding the provisions of Section (S) 15.1, during any period that the Aircraft, Airframe the Airframe, or any Engine is subject to CRAF in accordance with the provisions of Section (S) 7.2.3 and in the possession of the U.S. Government, Lessor shall not, as a result of any Lease Event of Default, exercise its remedies hereunder in such manner as to limit Lessee's control under this Lease (or any Permitted Sublessee's control under any Permitted Sublease) of the Aircraft, Airframe the Airframe, or such Engine, unless Lessor or Mortgagee gives at least 30 days' (or such other period as may then be applicable apply under CRAF) written notice of default hereunder shall have been given by Lessor or Mortgagee by registered or certified mail to Lessee (and any Permitted Sublessee) with a copy to the Contracting Officer Representative or Representatives for the Military Airlift Command of the United States Air Force to whom notices must be given under the contract governing Lessee's (or any Permitted Sublessee's) participation in CRAF with respect to the AircraftAircraft most recently identified by notice from Lessee to Lessor and Mortgagee pursuant (S) 7.2.3, Airframe the Airframe, or any Engine.

Notwithstanding the provisions of Section 15.1§ 14.1, during any period that the Aircraft, Airframe the Airframe, or any Engine is subject to CRAF in accordance with the provisions of Section § 7.2.3 and in the possession of the U.S. Government, Lessor shall not, as a result of any Lease Event of Default, exercise its remedies hereunder in such manner as to limit Lessee's ’s control under this Lease (or any Permitted Sublessee's ’s control under any Permitted Sublease) of the Aircraft, Airframe the Airframe, or such Engine, unless Lessor gives at least 30 days' ’ (or such other period as may then be applicable apply under CRAF) written notice of default hereunder shall have been given by Lessor or Mortgagee by registered or certified mail to Lessee (and any Permitted Sublessee) with a copy to the Contracting Officer Representative or Representatives for the Military Airlift Command of the United States Air Force Force, most-recently identified by notice from Lessee to Lessor pursuant § 7.2.3, to whom notices must be given under the contract governing Lessee's ’s (or any Permitted Sublessee's’s) participation in CRAF with respect to the Aircraft, Airframe the Airframe, or any Engine.

LIMITATIONS UNDER CRAF. Notwithstanding the provisions of Section 15.1, during any period that the Aircraft, Airframe or any Engine is subject to CRAF in accordance with the provisions of Section 7.2.3 and in the possession of the U.S. Government, Lessor shall not, as a result of any Lease Event of Default, exercise its remedies hereunder in such manner as to limit Lessee's control under this Lease (or any Permitted Sublessee's control under any Permitted Sublease, as the case may be) of the Aircraft, Airframe or such Engine, unless at least 30 days' (or such other period as may then be applicable under CRAF) written notice of default hereunder shall have been given by Lessor or Mortgagee Security Trustee by registered or certified mail to Lessee (and any Permitted Sublessee) with a copy to the Contracting Officer Representative or Representatives for the Military Airlift Command of the United States Air Force to whom notices must be given under the contract governing Lessee's (or any Permitted Sublessee's) participation in CRAF with respect to the Aircraft, Airframe or any Engine.

LIMITATIONS UNDER CRAF. Notwithstanding the provisions of Section 15.114, during any period that the Aircraft, Airframe or any Engine is subject to CRAF in accordance with the provisions of Section 7.2.3 and in the possession of the U.S. Government, Lessor shall not, as a result of any Lease Event of Default, exercise its remedies hereunder in such manner as to limit Lessee's ’s control under this Lease (or any Permitted Sublessee's ’s control under any Permitted Sublease) of the Aircraft, Airframe or such Engine, unless at least 30 60 days' ’ (or such other period as may then be applicable under CRAF) written notice of default hereunder shall have been given by Lessor or Mortgagee by registered or certified mail to Lessee (and any Permitted Sublessee) with a copy to the Contracting Officer Representative or Representatives for the Military Airlift Command of the United States Air Force to whom notices must be given under the contract governing Lessee's ’s (or any Permitted Sublessee's’s) participation in CRAF with respect to the Aircraft, Airframe or any Engine.
