Limits on Force Majeure Relief. Notwithstanding any other provision of this Article 14, neither Party shall be entitled to the benefit of Force Majeure under either or both of the following circumstances: (i) to the extent the failure to perform was caused by the negligence of the Party claiming Force Majeure; or (ii) to the extent the failure to perform was caused by the Party claiming Force Majeure having failed to remedy the condition and to resume the performance of such covenants or obligations with reasonable dispatch. Notwithstanding anything to the contrary herein, the Parties agree that the settlement of strikes, lockouts or other industrial disturbances shall be entirely within the discretion of the Party experiencing such disturbance.

  • Entitlement to Force Majeure relief An Affected Party is entitled to Force Majeure relief if and to the extent that:
