Common use of Liquidity Agent as Lender Clause in Contracts

Liquidity Agent as Lender. With respect to its commitment, the purchases made by it and any Notes held by it, Bank of Montreal shall have the same rights and powers, and shall be subject to the same conditions, under this agreement as any other Lender and may exercise, and shall be subject to, the same as though it were not the Liquidity Agent; and the term "Lender" or "Lenders" shall, unless otherwise expressly indicated, include Bank of Montreal in its individual capacity as a Lender. Bank of Montreal and its Affiliates may accept deposits from, lend money to and generally engage in any kind of business with the Trust, any Person who is a party to a Securitization Agreement or Affiliate of any such Person, any Obligor or any Affiliate of any Obligor and with any other Person who may do business with or own securities of any of the foregoing.
