List of Patients. Upon termination of this Agreement, Physician will not be denied access to any list of the Physician’s patients seen or treated within the one (1) year preceding the effective date of termination of this Agreement, and such list will be in a format no different than that by which such records are maintained, unless a different format is mutually agreed to in writing by the Physician and the Corporation.

Agree that, in addition to the Practitioner, a violation of the Non-Compete shall result in actual damages to the Employer that are difficult to accurately estimate. Practitioner shall pay such amount to the Employer as a reasonable buy-out of the Practitioner’s obligations to abide by the Non-Compete in the event that the Practitioner, at the Practitioner’s option, practices their Services or intends to practice their Services in violation of the Non-Compete upon termination of this Agreement; and
List of Patients. On or prior to the Effective Time, each of the Mariner Entities shall provide the SNH Entities with an accurate and complete list of the residents of each of the Retained Facilities and the Persons or Third Party Payor Programs responsible for payment of their charges.

13.4.2. The Contractor’s list of patients shall remain closed for a period of [ ]62 from the date on which the Contract comes into force. The Contractor’s list of patients shall remain closed for that whole period, unless the Contractor successfully applies for an extension to the closure period in accordance with clauses 13.21.1 to 13.21.11 or the Contractor and the Board agree that the Contractor should re-open its list of patients in accordance with clause 13.22.]63
13.4.3. The Board shall prepare and keep up to date a list of the patients- 60 Clauses 13.3.1, 13.3.2 and 13.3.3 must be included and clause 13.7.2 amended only where the parties agree there is to be an outer boundary area.
List of Patients. Seller will provide to Purchaser at the Facility a schedule setting forth the name of each patient of the Facility, the status of payment or level of care of each patient, and an accounting of security deposits and patient funds, which accounting is true, complete and correct in all Material respects. To Seller's Knowledge, the Facility's accounting of patient funds, which accounting is maintained as a ledger book in the offices of the Facility, is true, correct and complete in all Material respects, subject to routine periods for posting of transactions and is available for inspection by Purchaser in accordance with Section 8 hereof.

13.4.3 The Department shall prepare and keep up to date a list of the patients-
a) who have been accepted by the Contractor for inclusion in its list of patients under clauses 13.5.1 to 13.5.6 and 28.1.1 and who have not subsequently been removed from that list under clauses 13.9.2 to 14.16.3; and
b) who have been assigned bythe Department to the Contractor’s list of patients: i) under clauses 13.23

13.4.3. The Board shall prepare and keep up to date a list of the patients-
(a) who have been accepted by the Contractor for inclusion in its list of patients under clauses 13.5.1 to 13.5.6 and 28.1.1 and who have not subsequently been removed from that list under clauses 13.9.1 to 13.16.3; and
(b) who have been assigned to the Contractor under clause 13.23, or clause 13.24 and whose assignment has not subsequently been rescinded.
13.4.4. [The Board shall also include in the Contractor’s list of patients those patients who, on 31st March 2004, were recorded by the Board pursuant to regulation 19 of the National Health Service (General Medical Services) Regulations 1992 as being on the list of-

The Facilities's accounting of patient funds, which accounting is maintained as a ledger book in the offices of each of the Facilities, is true, correct and complete in all Material respects, subject to routine periods for posting of transactions and is available for inspection by Purchaser in accordance with Section 8 hereof. 3.03.
