Common use of Listing on an Exchange Clause in Contracts

Listing on an Exchange. If the Notes are to be issued as a Global Note in connection with the distribution of the Notes to the holders of the Preferred Securities issued by the Trust upon a Dissolution Event and/or Depositary Shares are issued upon conversion as provided in Article VII, the Company will use its best efforts to list such Notes or Depositary Shares, as the case may be, on the New York Stock Exchange or on such other exchange as the Preferred Securities are then listed.
