Common use of Loss of Service to SSO Customers Clause in Contracts

Loss of Service to SSO Customers. The Parties agree and acknowledge that service to SSO Customers may be lost due to storms, weather, accidents, breakage of equipment or other events beyond the reasonable control of Duke Energy Ohio affecting the transmission and distribution facilities of Duke Energy Ohio. No Party will have any liability to any other Party for the occurrence of such events. In no event will a loss of service to a Customer affect a Party’s obligation to make any payments then due or becoming due with respect to performance rendered prior to such loss of service.
