Loss of the Warranty claim for Reduction If the preconditions of § 4.11.1. exist and if a veto by the CL thus unjustified results in the amount of investment for the technical devices/installations/components specified by the CN in Annex 6 being fallen short of, the CL shall not be entitled to the warranty-claim for reduction set out in § 4.5.2. in so far as the deviation is due to the unjustified veto. Unjustified reduction amounts already collected by the CL shall be reimbursed.
