Common use of Lower Pricing Clause in Contracts

Lower Pricing. The State reserves the right to negotiate lower pricing, or to advertise for bids, whichever is in the State's best interest as determined by the Commissioner, in the event of a significant decrease in market price of any Product listed under the Contract. In addition, if the Contractor’s normal pricing to the public or to the trade in general is less than the NYS Net Contract Price, then the normal pricing to the public or to the trade in general shall also be granted by Contractor to Authorized Users. Price decreases to the Authorized User are permitted at any time, and do not need prior approval by Procurement Services. If, prior to the delivery of a Chassis Cab or Upfitted Truck by the Contractor, a price reduction is included in the applicable OEM or Contractor-Published Pricelist, a comparative price reduction shall be given to the Authorized User.
