Common use of Maintenance and Operation of Premises Clause in Contracts

Maintenance and Operation of Premises. The General Partners will cause the Property to be maintained in its present order and condition, normal wear and tear, and damage by fire or other casualty (subject to Section 12) excepted and will cause the continuation of the normal operation thereof, including the purchase and replacement of fixtures and equipment, and the continuation of the normal practice with respect to maintenance and repairs so that the Property will, except for normal wear and tear and damage by fire or other casualty (subject to Section 12), be in substantially the same physical condition on the Closing Date as on the date hereof.

The General Partners will cause the Property to be maintained in its present order and condition, normal wear and tear, and damage by fire or other casualty (subject to Section 1213) excepted and will cause the continuation of the normal operation thereof, including the purchase and replacement of fixtures and equipment, and the continuation of the normal practice with respect to maintenance and repairs so that the Property will, except for normal wear and tear and damage by fire or other casualty (subject to Section 1213), be in substantially the same physical condition on the Closing Date as on the date hereof.
