OPERATION AND MAINTENANCE OF COMMON AREAS. During the Term, Landlord shall operate all Common Areas within the Building and the Project. The term "Common Areas" shall mean all areas within the exterior boundaries of the Building and other buildings in the Project which are not held for exclusive use by persons entitled to occupy space, and all other appurtenant areas and improvements provided by Landlord for the common use of Landlord and tenants and their respective employees and invitees, including without limitation parking areas and structures, driveways, sidewalks, landscaped and planted areas, hallways and interior stairwells not located within the premises of any tenant, common electrical rooms and roof access entries, common entrances and lobbies, elevators, and restrooms not located within the premises of any tenant.

OPERATION AND MAINTENANCE OF COMMON AREAS. SECTION 6.01: The manner in which the parking and adjacent common areas shall be maintained and operated and the expenditures therefore shall be at the sole discretion of the Lessor and the use of such areas and facilities shall be subject to such regulations as Lessor shall make from time to time. Lessor shall not impose such regulations that would have an adverse, negative effect on the operation of the Lessee's business. SECTION 6.02: Lessee agrees to pay as rent to Lessor in the manner hereinafter provided, but not more often than once monthly, Lessee's proportionate share of all costs and expenses of every kind and nature paid or incurred by Lessor in operating, equipping, policing and protecting, lighting, insuring repairing, replacing and maintaining the common areas. Such costs and expenses shall include, but not be limited to, illumination and maintenance of the premises, signs, cleaning, lighting, line painting, landscaping, sewer and premiums for liability and property insurance; and an amount equal to Lessee's proportionate share of fifteen percent (15%) of the total of all of the foregoing costs and expenses to cover administrative cost. Any utilities furnished or supplied to any Lessee or the building which are not separately metered, shall be considered a cost to maintain the common areas and shall be included as part of such cost. For the purpose hereof, any charges for utilities contained in the foregoing costs and expenses shall be at the same rates as the rates for comparable service from applicable utility company serving the area in which the premises is located. The proportionate share to be paid by Tenant shall be computed on the basis that the total number of square feet of floor area in the leased premises bears to the total number of square feet of constructed leasable floor area at the premises. Lessee's proportionate share of such costs and expenses for each lease year and partial lease year shall be paid as rent in monthly installments on the 1st day of each calendar month, in advance, in an amount estimated by Lessor. Within ninety (90) days after the end of each lease year or partial lease year, Lessor shall furnish Lessee with a statement of the actual amount of Lessee's proportionate share of such costs and expenses for such period. OPERATION AND MAINTENANCE OF COMMON AREAS. 10.01. Landlord agrees to cause to be operated and maintained during the term of this Lease certain common areas servicing the building and other buildings of Landlord. The manner in which such areas and facilities shall be operated and maintained, and the expenditures therefor, shall be at the sole discretion of Landlord and the use of such areas and facilities shall be subject to such reasonable regulations as Landlord shall make from time to time.
OPERATION AND MAINTENANCE OF COMMON AREAS. 27 Landlord shall cause to be operated and maintained during the Term all “Common Areas” (as 28 defined below). The manner in which such areas and facilities shall be operated and maintained, and the 29 expenditures therefor, shall be at the sole discretion of Landlord and the use of such areas and facilities 30 shall be subject to such regulations as Landlord may establish, modify and enforce from time to time.

The term "Common Areas" shall mean all areas within the exterior boundaries of the Building and other buildings in the Project which are not held for exclusive use by persons entitled to occupy space, and all other appurtenant areas outside the exterior boundaries of the Building and other buildings in the Project provided by Landlord for the common use of Landlord and tenants and their respective employees and invitees, including, without limitation, parking areas and structures, driveways, sidewalks, landscaped and planted areas, hallways and interior stairwells not located within the premises of any tenant, common electrical rooms and roof access entries, common entrances and lobbies, elevators, and restrooms not located within any tenantable premises of the Building and/or other buildings in the Project. Building hours for any Building not wholly leased by Tenant shall be Monday through Friday 7:00 a.m. to 6:00 p.m., and Saturday 9:00 a.m. to 1:00 p.m., President's Day, Memorial Day, Independence Day, Labor Day, Thanksgiving Day, Christmas Day, New Year's Day and Sundays excluded. Tenant shall have access to its Premises twenty-four (24) hours per day, seven (7) days per week, fifty-two (52) weeks per year including access to utilities and heating, ventilating and air conditioning services but subject to Tenant's obligation to pay the reasonable costs of any such services used other than during the Building hours described above; provided that Landlord may install access control systems as it deems advisable for any Building not wholly leased by Tenant. The reasonable cost of maintaining and repairing any such access control systems (but not the cost of installation of, or any "capital" cost of replacing, said systems) shall be included in Project Costs under Section 4.2.
