Common use of MAINTENANCE AND REPAIRS OF IMPROVEMENTS Clause in Contracts

MAINTENANCE AND REPAIRS OF IMPROVEMENTS. Each Site and all Improvements thereon shall at all times be constructed, kept and maintained in first class condition, repair and appearance similar to that maintained by DECLARANT and other owners of high-class properties of similar class and construction in Los Angeles County, ordinary wear and tear excepted. All repairs, alterations, replacements, or additions to Improvements shall be at least equal to the original work in class and quality. The necessity and adequacy of such repairs shall be measured by the same standard as set forth above for the original construction and maintenance. Each owner shall also be responsible at all times for determining that all Improvements and the plans and specifications therefor shall conform and comply in all respects with the VALENCIA INDUSTRIAL CENTER RESTRICTIONS, all other restrictions of record, all applicable governmental regulations, and all exterior architectural design, location and color specifications as may be approved by DECLARANT. Each Owner shall also adopt and maintain such standards of property space maintenance, appearance, and housekeeping as shall be reasonable and customary for similar operations or enterprises and shall enforce compliance with such standards by all tenants, occupants, or users of space. On request, DECLARANT shall be entitled receive copies of all such standards or similar rules or regulations in effect from time to time. Notwithstanding anything to the contrary contained in the foregoing all exterior surfaces shall be maintained in first-class condition and shall be repainted at least once in every four (4) years.
