Common use of Maintenance and Repairs to the Leased Premises Clause in Contracts

Maintenance and Repairs to the Leased Premises. (Tie-down). The Lessor will provide the tie-down ground anchors. The lessee will provide the tie-down ropes/chains. The Lessor shall be responsible for all maintenance/repairs to the Leased Premises, including the ground anchors, except when necessitated by the negligence or willful misconduct of the Lessee, its agents, employees, or guests. The responsible party shall conduct such maintenance/repairs with due diligence at its own cost. If the maintenance/repairs are the responsibility of the Lessee, the rent shall not be abated during the period of maintenance/repairs. If the maintenance/repairs are the responsibility of the Lessor and the damage renders the Leased Premises untenantable for a period of 30 days or more, the rent shall be abated during the period of untenantability. If the maintenance/repairs are the responsibility of the Lessor and the damage renders the Leased Premises untenantable for 30 days or more, the Lessee shall have the option to terminate this agreement by notifying the Lessor in writing of this election during the above mentioned 30 day period. If the maintenance/repairs are the responsibility of the Lessee and the damage renders the Leased Premises untenantable for 30 days or more, the Lessor shall also have the option to terminate this agreement by notifying the Lessor in writing of this election at any time during the period on which the Leased Premises are untenantable.

The responsible party for said repairs shall conduct such maintenance/repairs with due diligence at its own cost. If the maintenance/repairs are the responsibility of the Lessee, the rent shall not be abated during the period of maintenance/repairs. If Lessee accepts the maintenance/repairs premises as suitable for the purpose for which same are leased and waives and any all defects therein, if any. Xxxxxx also agrees to keep the responsibility premises clean and free of any hazardous debris and to return the premises to Lessor, at the expiration of this Lease, in a condition comparable to the present condition of the premises, save and except ordinary wear and tear. Notwithstanding anything to the contrary, Lessee hereby covenants that he shall not open the door(s) to the leased premises if the wind velocity, whether constant or in gusts, shall be forty (40) miles per hour or greater. Xxxxxx hereby agrees that he shall close hangar door when said hangar is unattended. Xxxxxx further agrees to hold harmless Lessor for claims arising out of damage to property contained or stored in the Leased Premises. Notwithstanding the aforementioned, in no way shall Lessee make any structural modifications to the rented hangar space without prior written consent of Lessor and the damage renders the Leased Premises untenantable for a period of 30 days or more, the rent shall be abated during the period of untenantability. If the maintenance/repairs are the responsibility of the Lessor and the damage renders the Leased Premises untenantable for 30 days or more, the Lessee shall have the option to terminate this agreement by notifying the Lessor in writing of this election during the above mentioned 30 day period.
