Maintenance Charges. 6.1 The maintenance services for the Said Plot / Said Complex/Said Building, as set out in Annexure T-IV to this Lease Deed, shall be provided by THE LESSOR or its nominees/ assigns, the estimated Maintenance Charges for which shall be calculated prorata of the super built up area of the Demised Premises to the total super built-up area of the Property. 6.2 The Maintenance Charges for such maintenance services shall be paid to THE LESSOR or its nominees/ assigns, in advance for each month, as per the xxxx(s)/ invoice(s) raised by THE LESSOR or its nominees/ assigns. 6.3 The Maintenance Charges shall be subject to deduction of Income Tax at source as applicable, from time to time. 6.4 Any other taxes/ duties/ charges/ cesses / levy(ies) etc. as applicable from time to time on Maintenance Charges including service tax shall be payable by THE LESSEE in addition to the Maintenance Charges mentioned hereinabove as and when demanded by THE LESSOR. 6.5 The Maintenance Charges shall be payable by the Due Date, in advance for each month in respect of which such Maintenance Charges would be payable. 6.6 The Maintenance Charges as specified in this Lease Deed are subject to increase of prices of diesel, gas, petroleum products and other consumables, electricity rates, taxes, wages and salaries, cost of annual maintenance contracts of lifts, DGs, HVAC supplies, transformers, panels etc. during the Lease Term and the Lease Renewal Term (if any). 6.7 After completion of a financial year (i.e. from 1st April of a calendar year to 31st March of the next calendar year), THE LESSOR or its nominees / assigns will provide THE LESSEE, within a reasonable time period, a third party auditor certificate of expenditure/ expenses towards maintenance charges incurred during such financial year. Any under-recovery by THE LESSOR or its nominees/assigns shall become payable by THE LESSEE to THE LESSOR or its nominees/assigns and any over-recovery by THE LESSOR or its nominees/assigns shall become refundable by THE LESSOR/ or its nominees/assigns to THE LESSEE. Any such payment by refund to THE LESSEE shall be without any interest and such payment shall be payable by either party within thirty (30) days of providing such third party auditor certificate and issuance of credit/ debit note (as applicable).

Maintenance Charges. 6.1 The That the Licensee herein shall bear and pay all the maintenance services for the Said Plot / Said Complex/Said Buildingcharges of Rs. [[Amount in Numbers]] towards maintenance of Generator & Elevator, as set out in Annexure T-IV to this Lease DeedSalaries towards guards, shall be provided by THE LESSOR or its nominees/ assigns, the estimated Maintenance Charges for which shall be calculated prorata Electricity Maintenance for Common Areas, Charges towards cleaning of Common Areas and towards maintaining the lawn, whichever applicable, in respect of the super built up area said Licensed Premises, and other outgoings including all rates, taxes, levies, assessment, non-occupancy charges, xxx.xx respect of the Demised Premises to the total super built-up area of the Property. 6.2 The Maintenance Charges for such maintenance services said premises shall be paid to THE LESSOR or its nominees/ assignsby the Licensor. ELECTRICITY CHARGES That during the Rent period, in advance for each month, as per the xxxx(s)/ invoice(s) raised by THE LESSOR or its nominees/ assigns. 6.3 The Maintenance Charges shall be subject to deduction of Income Tax at source as applicable, from time to time. 6.4 Any other taxes/ duties/ charges/ cesses / levy(ies) etc. as applicable from time to time on Maintenance Charges including service tax shall be payable by THE LESSEE in addition to the Maintenance Charges mentioned hereinabove rental amount payable to the Landlord, the Tenant shall pay for the use of electricity and water as per bills received from the authorities concerned directly. For all the dues of electricity bills and when demanded water bills till the date the possession of the premises is handed over by THE LESSOR. 6.5 The Maintenance Charges the Landlord to the Tenant it is the responsibility of the Landlord to pay and clear them according to the readings on the respective meters . At the time of handing over possession of the premises back to the Landlord by Xxxxxx, it is the responsibility of the Tenant to pay electricity & water bills, as presented by the Departments concerned according to the readings on the respective meters upto the date of vacation of the property. That all the sanitary, electrical and other fittings and fixtures and appliances in the premises shall be payable handed over from the Landlord to the Tenant in good working condition. There will be 3 weeks maintenance period after the possession of Name of tenant . If during these 3 weeks any defect is in electrical outlets/appliances, plumbing/ sanitary is identified & duly notified, the Landlord shall be responsible to repair/ replace the same at his own cost. Upon returning the premises, all the sanitary, electrical and other fittings and fixtures will be restored by the Due DateTenant in a good condition as they are at present, in advance for each month in respect of which such Maintenance Charges would be payable. 6.6 The Maintenance Charges as specified in this Lease Deed are subject to increase normal wear and tear and damage by act of prices God. The Lessee shall pay the actual electricity, shared maintenance, water bills for the period of dieselthe agreement directly to the authorities concerned. The relevant `start date` meter readings are [Starting Meter Reading]. NO TENANCY That the Tenant shall not sublet, gas, petroleum products and other consumables, electricity rates, taxes, wages and salaries, cost of annual maintenance contracts of lifts, DGs, HVAC supplies, transformers, panels etc. during assign or part with the Lease Term demised premises in whole or part thereof to any person in any circumstances whatsoever and the Lease Renewal Term (if any). 6.7 After completion of a financial year (i.e. from 1st April of a calendar year same shall be used for the bonafide residential purposes only. That the Lessee shall have no right to 31st March create any sub-lease or assign or transfer in any manner the lease or give to any one the possession of the next calendar year), THE LESSOR said premises or its nominees / assigns will provide THE LESSEE, within a reasonable time period, a third party auditor certificate of expenditure/ expenses towards maintenance charges incurred during such financial year. Any under-recovery by THE LESSOR or its nominees/assigns shall become payable by THE LESSEE to THE LESSOR or its nominees/assigns and any over-recovery by THE LESSOR or its nominees/assigns shall become refundable by THE LESSOR/ or its nominees/assigns to THE LESSEE. "CAM Year," for purposes hereof, shall mean each twelve (12) month period corresponding to Landlord's fiscal year, which is currently the twelve (12) month period ending on March 31. (b) Common Area Maintenance Costs" shall be the total of all items of cost and issuance expense incurred in operating, managing, equipping, protecting, policing, securing, lighting, repairing, replacing and maintaining the Common Areas and their facilities, less contributions for particular items allocated and paid separately by any ground tenants in the Shopping Center. Common Area Maintenance Costs shall include, without limitation, all costs and expenses of credit/ debit note (1) maintaining, repairing and replacing the Common Areas as applicableshall be required in Landlord's judgment; (2) security, fire detection and protection and traffic direction and control; (3) cleaning and removing of rubbish, dirt, debris, water, snow and ice from the Common Areas (including removal of water, snow and ice from rooftops).; (4) planting, landscaping, re-planting and replacing flowers and landscaping; (5) water, drainage and sewage; (6) wages, health and welfare benefits, pension benefits, union dues, vacations, unemployment taxes and social security taxes; (7) personal property taxes; (8) permits and licenses; (9) supplies; (10) the operation of loud speakers and any other equipment supplying music; (11) utility services and lighting (including the cost of light bulbs and electric current); (12) patching, repairing, resurfacing, topping and marking of all parking and drive areas; (13) filling, sealing and supporting of sink holes; (14) depreciation of machinery and equipment used in the operation of the Common Areas (but not including depreciation of the original cost of acquiring the Common Areas of the Shopping Center); (15) all amounts payable by Landlord under any reciprocal easement agreement, covenant or easement binding upon the Shopping Center; (16) the charges of any independent contractor who, under contract with Landlord or its representatives, performs any work in connection with or relating to the operation, maintenance, repair or replacement of any part of the Common Areas; (17) any other expense or charge, whether or not hereinbefore mentioned, which, in accordance with generally accepted accounting and management principles, would be considered as an expense of managing, operating, maintaining or repairing the Common Areas, provided, however, that any capital expenditures shall, in accordance with generally accepted accounting principles, be amortized over the useful life of such asset; and (18) administrative charges in the amount of fifteen percent (15%) of the Common Area Maintenance Costs (exclusive of such administrative charges). The Promoter and/ or its nominated agency, as the case may be, shall raise, every month, the bills on the Allottee for the Maintenance Charges, which will be payable by the Due DateAllottee to the Promoter or to its nominees within seven days from the date of the Allottee receiving the same. The Promoter or its nominated agency, as the case may be, in advance due course of time, may also decide to issue quarterly bills for each month in respect of which such Maintenance Charges would be payable. 6.6 The Maintenance Charges as specified and in this Lease Deed case such bills are subject to increase of prices of dieselraised, gas, petroleum products and other consumables, electricity rates, taxes, wages and salaries, cost of annual maintenance contracts of lifts, DGs, HVAC supplies, transformers, panels etc. during the Lease Term and the Lease Renewal Term (if any). 6.7 After completion of a financial year (i.e. from 1st April of a calendar year to 31st March of the next calendar year), THE LESSOR or its nominees / assigns will provide THE LESSEE, within a reasonable time period, a third party auditor certificate of expenditure/ expenses towards maintenance charges incurred during such financial year. Maintenance Charges shall be fixed and shall be non-escalable for a period of 24 months from the date of Possession of the Designated Unit. However, in the event there is an increase in the power tariff by the concerned authorities during this period of 24 (30twenty four) days months, then the Maintenance Charges will be increased suitably to cover up the increase in such costs due to increase of providing such third party auditor certificate and issuance the power tariff. After the completion of credit/ debit note (as applicable)the said period of 24 months the Promoter or its nominated agency shall be entitled to increase the Maintenance Charges. The Maintenance activities will be operated by the Promoter or its nominated agency or agencies on commercial basis to ensure a reasonable return for the effort being made in respect of the maintenance by the Promoter or its nominee/nominated agency or agencies.

Maintenance Charges. 6.1 The maintenance services 5.1 In consideration of the Services provided by the Maintenance Agency and its appointed Property Manager in terms of the Article 4, the Occupant shall be liable to pay the Maintenance Agency for common area pertaining to the Premises, being used on 24 x 7 x 365 basis, the monthly Maintenance Charges calculated @ Rs. 21/- per sq ft. per month, for the Said Plot / Said Complex/Said Buildingperiod of one year from the date hereof, as set out subject however to any increase in Annexure T-IV to this Lease Deedthe cost of Diesel and electricity, which increase shall be provided borne solely by THE LESSOR or its nominees/ assignsthe Occupant, on pro-rata basis. (c) Maintenance Charges would be payableof Basement and Services in the Basement: These charges shall relate to maintenance of basement which include electric sub-station, pumps, fire-fighting rooms, transformer, DG sets, water tanks and other services. 6.6 (d) Charges for security services. (e) Charges for operation and maintenance of all Common Equipment including electro-mechanical equipment and /or any other equipment installed for rendering Services which shall include central air conditioning plants / equipment, generators, lifts etc. in the Complex. (f) Charges of electricity for the parking area and external Common Areas etc. (g) Meter hire charges and a minimum demand charge if the consumption falls below the minimum demand as per the applicable schedule tariff. (h) Charges of maintenance for landscaping of open areas in the Complex. (i) Charges for cleaning, painting and replacement in Common Areas. (j) Charges for administrative staff and the maintenance staff in the Complex. (k) Charges for diesel and lubricants for DG sets for common areas. (l) Charges for replacements / refurbishing. (m) Charges for insuring the Complex, building shell & Common Equipment. (n) Sinking fund. (o) Other necessary / ancillary expenses incurred in providing the Services. 5.4 The calculation of maintenance charges to be billed to the Occupant shall be done in the following manner: A) Cost of entire maintenance services provided by the Maintenance Charges as specified in this Lease Deed are subject to increase of prices of diesel, gas, petroleum products and other consumables, electricity rates, taxes, wages and salaries, Agency per month; B) Total cost of annual electrical energy for the Complex as per the bill paid to Dakshin Haryana Bijli Vitran Nigam (DHBVN) by the Maintenance Agency and the coxx xx operation and maintenance contracts of liftsDG Set(s) including fuel, DGs, HVAC supplies, transformers, panels etc. during the Lease Term and the Lease Renewal Term (if any). 6.7 After completion of a financial year (i.e. from 1st April of a calendar year to 31st March of the next calendar year), THE LESSOR or its nominees / assigns will provide THE LESSEE, within a reasonable time period, a third party auditor certificate of expenditure/ expenses towards maintenance charges incurred during such financial year.
