Common use of Maintenance Charges Clause in Contracts

Maintenance Charges. 17.1 If any maintenance charges for the Goods have been included in the Rental Instalments, you acknowledge that: (a) you have given CNH Industrial Capital a direction to pay the maintenance provider and to include such charges in the Rental Instalments; (b) CNH Industrial Capital is not responsible for the maintenance of the Goods; (c) any failure or breach on the part of the maintenance provider will not in any way release you from the requirement for you to pay the Rental Instalments and observe your other obligations under this Hire Purchase Agreement.
