MAINTENANCE IN. CHARGE shall upon formation of the Maintenance Company and its taking over charge of the acts relating to the Common Purposes from the Promoter shall mean the Maintenance Company and till such time the Maintenance Company is formed and takes over charge of the acts relating to the Common Purposes shall mean the Promoter.

CHARGE shall upon formation of the Maintenance Company and its taking over charge of the acts relating to the Common Purposes from the Promoter shall mean the Maintenance Company and till such time the Maintenance Company is formed and takes over charge of the acts relating to the Common Purposes shall mean the Promoter. xix) DEEMED DATE OF POSSESSION/DATE OF COMMENCEMENT OF LIABILITY shall mean the date on which the Allottee takes actual physical possession of the said Unit after fulfilling all his liabilities and obligations in terms of the clause 7 hereinbefore or the date of expiry of the period specified in the notice by the Promoter to the Allottee to take possession of the said Unit in terms of the said clause 7 irrespective of whether the Allottee takes actual physical possession of the said Unit or not, whichever be earlier.
MAINTENANCE IN. CHARGE shall upon formation of the Association and its taking over charge of the acts relating to the Common Purposes from the Promoter shall mean the Association and till such time the Association is formed and takes over charge of the acts relating to the Common Purposes shall mean the Promoter or any Maintenance Agency appointed by the Promoter or the Project Manager and for such acts the Promoter / Maintenance Agency / Project Manager shall charge 15% as their management fee.

MAINTENANCE IN. CHARGE shall mean and include the said I– RED PROJECTS LIMITED, a company incorporated under the Companies Act, having its registered office at 0, Xxxxx Xxxxx Xxxxx Avenue, Kolkata 700 013 and its executors, administrators, representatives and assigns and such other Firm, Company, as may be nominated by the Developer.

CHARGE shall upon formation of the Maintenance Company and its taking over charge of the acts relating to the Common Purposes from the Promoter shall mean the Maintenance Company and till such time the Maintenance Company is formed and takes over charge of the acts relating to the Common Purposes shall mean the Promoter. xix) DEEMED DATE OF POSSESSION / DATE OF COMMENCEMENT OF LIABILITY shall mean the date on which the Allottee takes actual physical possession of the said Apartment / Unit after fulfilling all his liabilities and obligations in terms of this agreement or 15 days after issue of notice by the Promoter to the Allottee to take possession of the said Apartment / Unit in terms of the said clause 7.2 and its sub- clauses irrespective of whether the Allottee takes actual physical possession of the said Apartment / Unit or not, whichever be earlier.
