MAINTENANCE OF A BUSINESS CONTINGENCY PLAN. The Agent has maintained since the Effective Date, and shall continue to maintain during the Term and shall perform the Services consistent with, a disaster recovery and business contingency plan to address the continuity of the Agent’s performance of the Services in the event of a contingency that renders any or all of the Agent Facilities unavailable for supporting the Agent’s performance of those Services which are to be operational under such plan (the “Business Contingency Plan”).
