Contingency Plan. Contractor is aware that unforeseen circumstances, Including damage to their Facility(ies), equipment breakdowns, weather-related emergencies and other Force Majeur events, may require their participation in non-scheduled operations in order to provide continuous service to the public. Contractor hereby acknowledges that, under this Agreement, they are prepared to commit to participation in training for such emergency scenarios and to provide vehicles and personnel to maintain uninterrupted service during impairment or breakdown of Contractor’s Facility or equipment, and in case of natural disaster or other emergency, Including the events described in Section 15.09.
Contingency Plan. You agree that, in the event you are not able to capture, process, produce or transmit a Mobile Deposit to Bank, or otherwise comply with the terms hereof or of the Procedures, for any reason, including, but not limited to, communications, equipment or software outages, interruptions or failures, you will make the deposit in a manner consistent with other methods for making deposits provided by Bank until such time that the outage, interruption or failure is identified and resolved. You hereby acknowledge and agree that Bank shall not be liable to you for any loss or damage of any nature sustained by you as the result of your inability to use the Mobile Deposit Service. The deposit of original Checks through these other methods shall be governed by the terms and conditions of the Deposit Account Agreement and not by the terms of this Agreement.
Contingency Plan. Contractor must have a written Contingency Plan approved by Department that addresses the following: an identified alternate location for offenders to reside temporarily for approximately a ninety (90) day duration, that provides adequate life support resources (i.e. food, shelter, water, personal hygiene) in the event of a natural or man-made event (i.e. earthquake, wildfire, prolonged/catastrophic utility failure, etc.) which renders the facility uninhabitable.
Contingency Plan. Because the Mobile Remote Deposit Capture Service could be unavailable from time to time for various reasons, you should not rely on the Service as the sole means of depositing checks to your Mobile RDC Account or loading funds to your Mobile RDC Card. In the event you wish to deposit any check to your Mobile RDC Account or to load funds represented by any check to your Mobile RDC Card and you are unable to transmit the image of the check to us through the Service or are unable to use the Service in compliance with the terms of this Agreement for any reason (including, without limitation, reasons related to communications, equipment or software outages, interruptions or failures), you acknowledge and agree that you are solely responsible for using alternative available means of depositing the check to your Mobile RDC Account or loading check funds to your Mobile RDC Card. Such alternative means will be governed by the terms of the agreement governing your Mobile RDC Account or Mobile RDC Card, as applicable, and not by the terms of the Mobile Remote Deposit Capture Service. You assume the risk that we may not accept a check image that you attempt to transmit through the Service. We shall have no liability to you in the event we do not accept the transmission of a check image for any reason and you subsequently have difficulty negotiating or are unable to negotiate the check due to any endorsements you may have applied to the check in your attempt to use the Service.
Contingency Plan. Contractor shall submit to Agency ninety (90) Days prior to Commencement Date, a written contingency plan demonstrating Contractor's arrangements to provide vehicles and personnel and to maintain uninterrupted service during breakdowns, and in case of natural disaster or other emergency, including the events described in Section 14.09.
Contingency Plan. In the event, you are unable to capture, balance, process, produce or transmit a file to the Credit Union, or otherwise comply with the terms or the procedures for any reason, including but not limited to, communications, equipment or software outages, interruptions or failures, you will transport or mail the originals of all checks to the closest Credit Union location. The deposit of original checks at an office of the Credit Union shall be governed by the terms and conditions of the Deposit Account Agreement and not by the terms of this Agreement.
Contingency Plan. Customer agrees that in the event that Customer is not able to capture, balance, process, or otherwise transmit a File to Bank, or otherwise comply with the terms hereof or of the Procedures, for any reason, including but not limited to communications, equipment or software outages, interruptions or failures, Customer will transport the physical Checks and deposits to the closest office of Bank and deposit the original Checks with Bank until such time that the outage or other interruption can be identified and resolved. Customer hereby acknowledges and agrees that Bank shall not be liable to Customer for any loss or damage of any nature sustained by Customer as the result of the inability of Customer to use the Service. The deposit of original Checks at an office of Bank shall be governed by the terms and conditions contained in the Deposit Account Agreement and not by the terms of this Agreement.
Contingency Plan. ACS shall maintain a reasonably comprehensive contingency plan for disaster recovery and continued servicing of the Accounts (the “Plan”) and allow LENDER to review said Plan at ACS’s site. Such review shall be no more frequently than on an annual basis or within sixty (60) days of implementing any material changes to the Plan.
Contingency Plan. Sub-Administrator agrees to release the information necessary to allow Administrator to develop necessary disaster contingency and continuity of business plans, which will work in concert with Sub-Administrator’s plans.
Contingency Plan. To ensure personnel continuity, the Grantee shall provide a contingency plan, within five (5) Business Days of the Key Personnel vacancy, in the event Key Personnel vacancies exceed ten (10) Calendar Days. At a minimum, the plan should include the specific names of the substitute agency personnel who have been assigned to carry out the duties and responsibilities of the absent Key Personnel members. In addition, the Grantee shall provide a brief description of pertinent training and qualifications the substitute agency personnel have for the functions they will perform.
