Common use of Maintenance of VEBA Plan Clause in Contracts

Maintenance of VEBA Plan. The Employer will maintain its Voluntary Employees’ Beneficiary Association medical expense plan during the term of this Agreement. All eligible employees who retire during a calendar year will participate in the VEBA plan unless a majority of retirement eligible employees determines through a majority vote that they do not wish to participate in the VEBA plan during that calendar year. In the event of a tie, the default for the calendar year will follow the determination from the prior calendar year. Eligibility to vote, and procedures for voting to determine participation in the VEBA plan will be determined according to the Employer’s Voluntary Employees’ Beneficiary Association medical expense plan procedures.
