Common use of Maintenance Work by the City Clause in Contracts

Maintenance Work by the City. The Contractor agrees that, should it be necessary for the City to do maintenance or emergency Work on or near the site of the Work, or to do any other Work that is not a part of the Contract requirements but deemed expedient by the Engineer, the Contractor will not cause any interference thereto, and further agrees that it will not claim any damages or extra compensation if such maintenance or emergency Work should delay the Contractor’s Work or cause the Contractor move its equipment and other materials. If any such Work by the City should delay the Contractor and cause it to move its plant and materials, the Contractor’s right to an extension of time for performing the whole Work under this Contract, as provided in Article 13 of Part H of this Contract (General Conditions), shall be considered as sufficient compensation thereof.
