Major Releases Sample Clauses
Major Releases. For Recordings to be distributed or released via a Major Label or Large Indie Label, or any Minor Release that exceeds one million streams on Apple Music, Spotify or YouTube (each such release, a “Major Release"), you shall be required to:
(a) Contact us at promptly to seek clearance for use of the Sample on a Major Release;
(b) Provide for a 50/50 split of any Advances, Producer Royalty and Publishing, including for the avoidance of doubt, in relation to any so-called 'synch licenses’; and
(c) Provide [us/the creator of the applicable Sample] with Co-Producer credit on the liner notes of any singles or albums (in any configuration), in advertisements, and wherever metadata permits.
Major Releases. A. For Recordings to be distributed and/or released via a Major Label, or a subsidiary of a Major Label, or a Large Indie Label, or any Minor Release that exceeds one million streams on a DSP; you are required to do the following.
1. Contact the Composer(s) promptly via the email(s) listed below to request clearance of a Sample on a Major Release.
2. Provide for a 50/50 split of any Advances, Publishing, Royalties, and any other relatable fees.
3. Provide the Composers with a Production Credit with correct stylization wherever the metadata is applicable as well as on the liner notes of any singles or albums. Any other Composer(s) that is noted on the Sample must also be given a Production Credit wherever the metadata is applicable as well as on the liner notes of any singles or albums.
Major Releases. Customer agrees to implement any Major Release issued during the Term by the later of:
4.12.1.1 (A) with respect to the first Major Release following the Major Release implemented upon the Target Date, ***** , and (B) with respect to any subsequent Major Release issued during the Term, ***** the date on which NAVITAIRE first offers to implement such Major Release among its customers generally, during either such period NAVITAIRE (a) may continue to issue Current Releases intended to be used in conjunction with the prior Major Release included in the Production Version, (b) shall continue to issue Maintenance Releases as needed to correct System Errors which would otherwise materially compromise the functionality of the Production Version and for which no work around exists, and (c) shall have no obligation to provide Enhancements for the prior Major Release included in the Production Version; and *****Confidential portions of the material have been omitted and filed separately with the Securities and Exchange Commission. 4.12.1.2 The date on which NAVITAIRE ceases to provide support to customers receiving hosted services based on such prior Major Release.
Major Releases. The latest major release software, which is usually released each year. New versions may contain technical as well as functional adaptations or improvements. Technical adaptations may also include support for newer versions of operating systems and database systems. Generally, modified functions result in changes to the user documentation. For the company's own products, the version number for a major release can be identified by the first block of numbers and is provided with a build number. Major releases are also called "software upgrades".
Major Releases. TeamViewer may, at its sole discretion, also elect to offer major releases of the Software for download (“Major Releases”, Minor Releases and Major Releases, both a “Release”), usually comprising more extensive modifications of the Software functions. The new Software version which contains the Major Release (“Major Release Version”, Minor Release Versions and Major Release Versions, both a “Version”) may be marked by TeamViewer – in its sole discretion – by a change of the main version number (e.g. version XX, YY). TeamViewer shall not be obligated to provide any Major Release Versions of the Software. In the event that TeamViewer elects to provide a Major Release Version of the Software, TeamViewer may require the Customers of Perpetual licenses to pay an additional fee for use of such new Major Release Version. The Customers of Subscription licenses and Free Version shall be obligated by way of a contributory duty (Mitwirkungsobliegenheit) to upgrade to the new Major Release Version as soon as reasonably practicable. All rights of use set forth herein that are applicable to the Software shall also apply to Major Releases.
Major Releases. From time to time, IPsoft may also provide periodic major Releases. Major Releases are generally available Releases of the Product that provide Enhancements designated major by IPsoft, as well as minor new Enhancements and Error Corrections. Such a Release is denoted by a change in the digit to the left of the first decimal point (for example, 3.0 to 4.0). IPsoft will provide a licensed copy of all Maintenance Releases and Minor Releases which IPsoft makes generally available to its customers during the Term of this Schedule. IPsoft will waive the license fee, if any, generally charged to customers for the Maintenance Releases and Minor Releases. Maintenance Releases and Minor Releases will be subject to the terms and conditions of this Schedule. New Major Releases of the Product, and new products or services not included within the Product, are not provided to You under this Schedule unless explicitly specified in the Order.
Major Releases. Sunbird may provide periodic Major Releases. Major Releases are generally available releases of the Software that provides Enhancements designated major by Sunbird, as well as minor new Enhancements and Error Corrections. Such a release is denoted by a change in the digit to the left of the first decimal point - for example, 3.0 to 4.0.
Major Releases. “Major Releases” are less frequently scheduled releases of modified versions of the Software that include upgrades, new application functionality, and/or significant technological advancements compared to the last Major Release. Relativity may consider cumulative improvements provided in Minor Releases since the last Major Release in determining whether the overall upgrades, new application functionalities, and/or significant technological advancements justify designation of a new Major Release. New Major Releases are only included as part of the annual fee pricing during the initial three (3) year term of this Agreement (and during any new three (3) year renewal term if the parties enter into a mutually satisfactory formal written amendment for a renewal term, unless such amendment provides otherwise). A Major Release can be distinguished by having one primary digit in the release number (e.g. Version 9.0).
