Common use of Market Quotation Clause in Contracts

Market Quotation. (a) For the purpose of determining the Market Quotation, the Buyer shall select, with the consent of Xxxxxxx Mac, four leading participants in the interest rate cap market (each a “Reference Market-maker”), in its sole discretion and in good faith, with a view to minimizing the Market Quotation (to the extent required by law); provided, however, that in doing so the Buyer shall be entitled to select market participants that are of the highest credit standing and that otherwise satisfy all the criteria that the Buyer applies generally at the time in deciding whether to enter into an interest rate protection transaction.
