Marketing Decisions. Customer acknowledges that (a) Customer is responsible for all marketing decisions, whether made by or on the advice of independent advisory service or otherwise; and (b) Customer has not relied upon, and will not rely on, any written or oral representations of Prairie Central Cooperative in making any marketing decisions.

Marketing Decisions. TCMI, in consultation with CORPORATION, shall determine the content of all marketing materials prepared for the purpose of promoting or marketing the Product.
Marketing Decisions. Distributor shall control and make all decisions regarding the strategy and tactics of Marketing, selling and otherwise commercializing the Products for use in the Field in the Territory, including, without limitation, the methods of sale and distribution, organization and management of sales and Marketing, Packaging, pricing, and Labeling, appointment of SubDistributors, and other terms and conditions of such sales and Marketing. Notwithstanding the aforesaid, Distributor shall consult with Can-Xxxx prior to taking any material decision regarding the strategy and tactics of Marketing, selling and otherwise commercializing the Products in the Territory.
Marketing Decisions. Except as expressly set forth in Section 3.1 ("Maxtor Rights") above, Maxtor will have complete responsibility and authority for all decisions regarding the marketing and sale of the Products. Maxtor will evaluate and determine the distribution methods, the organization to be established, the customers to whom the Products will be sold and the strategy to be utilized. Maxtor shall further be responsible for planning and reviewing marketing opportunities. Maxtor is responsible for all costs incurred in the sale and marketing of the Products.

Quantum will evaluate and determine the distribution methods, the organization to be established, the customers to whom the Products will be sold and the strategy to be utilized. Quantum shall further be responsible for planning and reviewing marketing opportunities. Quantum is responsible for all costs incurred in the sale and marketing of the Products. Quantum agrees that all Products will be manufactured by and purchased from MKE, except as otherwise provided in this Agreement.
Marketing Decisions. All marketing decisions with respect to the auction shall be made solely by Xxxxxx/Auctioneer.
