Common use of Marketing, Generally Clause in Contracts

Marketing, Generally. (A) The Contractor, its employees, Network Providers, agents, or Subcontractors shall not conduct direct or indirect Marketing of the Health Plan except as outlined in 3.1.3. (B) The Contractor shall not market to or otherwise attempt to influence the Department’s Health Plan Representatives or local Health Department staff to encourage Enrollees or Potential Enrollees to enroll in the Contractor’s Health Plan.
