Common use of Maximum number of Utilisations Clause in Contracts

Maximum number of Utilisations. (a) A Borrower may not deliver a Utilisation Request under the Revolving Credit Facility if as a result of the proposed Utilisation 10 or more Revolving Credit Facility Loans would be outstanding. (b) A Borrower may not request that a Term Loan Facility Loan be divided.

Maximum number of Utilisations. (a) A Borrower (or the Parent) may not deliver a Utilisation Request under the Revolving Credit Facility if as a result of the proposed Utilisation 10 six or more Revolving Credit Facility Term Loans would be outstanding. (b) A Borrower (or the Parent) may not request that a Term Loan Facility A Loan be divideddivided if, as a result of the proposed division, three or more Facility A Loans would be outstanding.

(a) A Borrower may not deliver a Utilisation Request under the Revolving Credit for Facility A if as a result of the proposed Utilisation 10 6 or more Revolving Credit Facility A Loans would be outstanding. (b) A Borrower may not request that the Letter of Credit be issued under Facility B if, as a Term Loan Facility Loan result of the proposed Utilisation, 2 or more Letters of Credit would be dividedoutstanding.

(b) A Borrower may not request that a Term Loan Facility A Loan be divideddivided if, as a result of the proposed division, more than 10 Facility A Loans would be outstanding. (c) A Borrower may not deliver a Utilisation Request or Selection Notice if as a result Utilisations denominated in more than 3 Optional Currencies would be outstanding.
