Common use of MCO must Clause in Contracts

MCO must. (1) actively monitor the quality of care and services, as well as the quality of reporting data, provided under a Subcontract; (2) provide HHSC with a copy of TDI filings of delegation agreements; (3) unless otherwise provided in this Contract, provide HHSC with written notice no later than: (i) three (3) Business Days after receiving notice from a Material Subcontractor of its intent to terminate a Subcontract; (ii) 180 calendar days prior to the termination date of a Material Subcontract for MIS systems operation or reporting; (iii) 90 calendar days prior to the termination date of a Material Subcontract for non-MIS MCO Administrative Services; and (iv) 30 calendar days prior to the termination date of any other Material Subcontract. HHSC may grant a written exception to these notice requirements if, in HHSC’s reasonable determination, the MCO has shown good cause for a shorter notice period.
