Mediator’s Role. The Mediator will be neutral and impartial. The Mediator will assist the Parties to isolate the issues, develop and explore options for resolution of these issues and, if possible, achieve expeditious resolution of the Disputes by agreement between them. The Mediator makes no representation that any such agreement between the Parties will equate with any result which might be achieved by a contested trial of the Disputes or any part of them
Mediator’s Role. All parties should be aware that it is not the role of the mediator to make a determination of the dispute or decisions for the parties. It is, therefore, very important that the disputants and their legal advisers come to the mediation fully equipped and prepared to negotiate on the issues and with the authority to sign an agreement should one be reached.

In the event that the parties are unable to reach an agreement on the subject matter of the dispute, the parties agree that the Mediator is empowered to make decisions for the parties as to how the matter should or must be resolved. The parties hereby agree that they will abide by the decisions voluntarily reached in the matter or will be bound by the decision of the Mediator in the event that the rendering of such a decision occurs. The parties further agree that, in the event that a decision is rendered by the Mediator, such decision shall not be subject to judicial or arbitral review and each party hereby undertakes to take no further proceedings in such a circumstance.

He will not provide legal representation or advice to any party at any time, and has no duty to assert or protect the legal rights and responsibilities of any party, to raise any issue by the parties themselves, to make any decisions on behalf of the parties, or to determine any issues.

If Clients do not resolve all disputes, the Mediator will conduct an evaluation and make a recommendation to the Court regarding any unresolved issues.

Once familiar with the issues involved in the mediation, the mediator shall, if requested by both of the parties, give an opinion of the probable outcome of the case and a range of settlement value and trial value if the case were litigated. The mediator shall, in the absence of instructions from the parties to the contrary, give recommendations regarding the possible settlement terms and conditions. The opinions and recommendations of the mediator are not binding on the parties.

The participants confirm that they have had no prior dealings with the mediator and that they do not know him/ her. The mediator will facilitate discussions between the participants and assist them in their negotiations to: either resolve the dispute between them in its entirety. or identify issues upon which agreement can be reached or explore areas of compromise or generate options to resolve the dispute or clarify priorities The participants undertake to respect the mediation process, the mediator and one another during the mediation. To that end they will not interrupt one another or the mediator during joint sessions.
