Meet Technical Specifications and Service Levels. Nothing in this Section shall be interpreted to limit Contractor’s obligation to replace any Equipment (a) pursuant to any other provision of this Contract, or (b) as necessary to operate the NEPP in accordance with the applicable Technical Specifications and to otherwise meet the applicable Service Levels in respect of all Services throughout the Term. Thus, Contractor shall at times during the Term be solely responsible for ensuring that the Equipment used in connection with the NEPP is appropriate for Contractor to operate the NEPP in accordance with the applicable Technical Specifications and to perform all Services in accordance with the applicable Service Levels. Accordingly, Contractor shall timely (a) replace any Equipment that needs to be replaced, and (b) provide additional Equipment that is required, in each case, in order that the NEPP is at all times operated in accordance with the applicable Technical Specifications and all Services are at all times performed at least in accordance with the applicable Service Levels.
