Common use of Member Protection Clause in Contracts

Member Protection. Any teacher who is dissatisfied with the Employer’s response to his/her complaint of harassment may file a grievance (ARTICLE 17). However, whenever resort to the grievance procedure would result in the accused xxxxxxxx hearing the grievance, the grievance may be transmitted to the next step at the option of the grievant. The District assures employees that all complaints will be handled confidentially and shall be investigated without delay. In no event will the District permit or engage in retaliation of any kind against any employee who initiates a complaint. Any teacher accused of sexual harassment shall be entitled to all the protections of this Agreement, including, but not limited to, those provisions in ARTICLE 13, ARTICLE 16, and ARTICLE 17.
