Common use of Member Totally Disabled Clause in Contracts

Member Totally Disabled. Except as expressly provided in this Article, all rights to Benefits hereunder shall terminate as of the effective date of termination of this Agreement. If, when this Agreement is terminated, any Member has a condition for which Benefits are available under this Agreement, which condition has rendered the Member Totally Disabled as of the date of termination, then such Member shall be covered, subject to all Limitations, Exclusions and conditions of this Agreement, including payment of Copayments and Premiums, for the disabling condition until the earlier of: (a) the end of the 12th month after termination of this Agreement; (b) the Member is no longer Totally Disabled; or (c) such time as the Member obtains coverage under a replacement contract or policy issued without limitation as to the disabling condition.
