Minimizing Potential Adverse Effects. 717 In addition to satisfying the conditions set out in subsections 23.16 (4) and (5), 718 subsection (6) outlines the steps the proponent must take to minimize adverse 719 effects when engaging in any activity within a safe harbour habitat that would 720 otherwise be prohibited by section 10 of the ESA. These steps help to minimize 721 the risk of adverse effects to the species at risk for which safe harbour habitat 722 area was created or enhanced for. 723 As per subsection 23.16 (9), a person may also be exempt from clause 9(1)(a) of 724 the ESA when engaging in activities in the safe harbour habitat after the 725 instrument has ended. However, the proponent must make every reasonable 726 effort to rescue or salvage individual members, to avoid killing a member of the 727 species. 728 729 8.0 Additional Considerations‌ 730 The concept of safe harbour has been implemented in a number of jurisdictions 731 and has shown success in encouraging conservation activities for species at risk 732 on private lands. New insights have been gained from these experiences that 733 may also warrant some additional consideration when developing safe harbour 734 instruments in Ontario.
