Common use of Minimum Standards Clause in Contracts

Minimum Standards. The ESFA may, at any time during the Contract, undertake an assessment of the quality and delivery of the Services which may include analysis of performance against the national minimum quality standards, as published by the ESFA and/or the ESFA on XXX.XX ‘Qualification achievement rates and minimum standards’.

Minimum Standards. The ESFA may, at any time during the ContractTerm, undertake an assessment of the quality and delivery of the Services Provision which may include analysis of performance against the national minimum quality standards, as published by the ESFA and/or Department and / or the ESFA. Where the ESFA on XXX.XX ‘Qualification achievement rates and minimum assesses that the Provision, in whole or in part, falls below the required standards’., the ESFA may, in its absolute discretion, take one or more of the following actions:
